This approval allows relief from Section 4 . 15. 3 . 5 of the Albemarle County Zoning Ordinance to increase the sign area for two wall signs from 20 square feet to 84 square feet total . Patterson PUBLIC HEARING: August 21, 1990 STAFF REPORT - VA-90-56 OWNER/APPLICANT: Shenandoah's Pride Dairy TAX MAP/PARCEL: 77/11D1 ZONING: PUD, Planned Unit Development ACREAGE: 3 . 143 acres LOCATION: In Mill Creek Industrial Park on the west side of Avon Street and the north side of the Collector Road. REQUEST: The applicant requests relief from Section 4 . 15. 3 . 5 of the Albemarle County Zoning Ordinance, which states: "4 . 15. 3 . 5 Residential (R-10 and R-15) ; Planned Residential Development (PRD) and Planned Unit Development (PUD) Business Signs: Limited to wall signs with an aggregate area not to exceed twenty (20) square feet. . . " The applicant seeks a variance to increase the aggregate sign area for two wall signs from 20 to 84 square feet. They propose signs for two tenants: "Shenandoah's Pride Dairy" of 54 square feet and "Cassco Ice" of 30 square feet. The signs will be non-illuminated 18" tall anodized commercial aluminum, erected on a brick face. It will look like that for the Michie Company off Carlton Road. The applicant's justification includes: 1. Twenty (20) square feet for the entire building with two businesses of 240 linear feet frontage is not sufficient. 2 . Due to the severe drop in grade from both roads and the presence of two businesses with signage needs, the signs would not be visible. 3 . The proposed sign areas are minimized, considering the scale of the building. The building consists of 240 linear feet of frontage. The resulting ratio would be . 35 square feet to 1 linear foot. Page 2 Staff Report - VA-90-56 RELEVANT HISTORY: Staff recognizes that each variance is reviewed on its own merits, and is not on its face, precedent-setting. The following history is provided for information: None has been submitted for wall signage in this immediate area. VA-89-100 Mill Creek Land Trust was approved on January 9, 1990 to allow a freestanding sign for this business park to be located in the corner of this property at the collector road entrance. RECOMMENDATION Staff concurs with the applicant's justification. The proposed sign areas would not exceed that which staff will recommend for the new sign ordinance. We also support the fact that the signs will not be illuminated. The building is located approximately 100 feet from Avon Street and 80 feet from the collector road. If required to comply with the Zoning Ordinance, each business sign would total 10 square feet, or approximately 3 . 15 by 3 . 15 feet. Staff recommends approval for cause: 1. The applicant has provided evidence that the strict application of the ordinance would produce undue hardship; 2 . The applicant has provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity; 3 . The applicant has provided evidence that the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. Staff recommends the following condition of approval: 1. The signs shall not be illuminated.
