This answer is to express my views, which I know are shared by other property owners in Bellair, as well as by those whose properties are either immediately contiguous or facing the Hamp property. There are several reasons that lead me to suggest the Board not entertain the request it has in front of it. First and foremost, the covenant of the Bellair homeowners clearly states that all accessory buildings shall be attached and not detached from the original house. A survey of the neighborhood indicates that this has been respected for all structures visible from the road. Granting the variance would thus go against the covenant, as the new structure would stand some 50 feet away from the main house and in plain and obvious view to all passers by. Secondly, I see no reason to grant the requested variance, in view of the amount of land available to the petitioner which would permit him to build an attached car port that would respect both the Albemarle County Zoning Ordinance and the Bellair covenant. Thirdly, as proposed, I find the structrure ungainly and esthetically unpleasing. My property and that of others would be faced by a 24 x 24 x 12 car port, set on an incline, clearly off the line of the main house, abutting a fence, detached and sloping, with a roof resembling a cross between a truncated pagoda and a wigwam. Finally, a sideless structure --whatever its utility in view of the pre-existing two car garage-- could very easily become a full size additional garage, with sides and doors, and we would have very little recourse or means to oppose such a possible transformation in the future were it to become reality. I thus respectfully suggest that the Board of Zoning Appeals not grant the variance requested, and I apologize for not being able to attend its meeting. However, the Board does not have the legal power and authority to approve the proposed location of the carport which, as you have described it, would be within one foot of your side property line, and which would therefore violate Bellair restrictive covenant number (4) which provides in part that "no portion of any building shall be less than ten feet from the side or rear lot boundaries" . I hope that you will understand that the Board simply does not have the legal authority under any circumstances to waive the requirements of one of the Bellair restrictive covenants.
