This letter if to notify you, as adjoining property owners, that
Roger B. and Norma L. Smith (owners) , property described as Tax
Map 57 , Parcel 104 , Zoned RA, Rural Areas, has made application
for VA-90-60, requesting relief from Section 10.4 of the Albemarle
County Zoning Ordinance, as follows:
Applicant seeks a variance to reduce the front setback from
75 feet to 60 feet for construction of a single-family home.
A public hearing will be held by the Board of Zoning Appeals on
September 11, 1990, at 3 : 00 p.m. , in Meeting Room #7, Second
Floor, County Office Building, 401 McIntire Road, Charlottesville,

I have Just become aware of the referenced request for a
zoning variance, to be considered on 11 September. As a
resident on State Route 682 I oppose the requested variance
to the current zoning provisions.
SR 682 is a rural road with all of the environmental
characteristics normally associated with a rural road. The
requested variance would permit a building to be constructed
more than otherwise allowed in direct view of the road,
under conditions that an use of visual screening would be
quite ineffective. The building site is elevated above a
significant graded slope on the outside of a curve in the
road. Such a building, in sight of all who passes, would be
unique to the area and result in an undesirable effect on
the otherwise quiescent rural character of the environment.
To my knowledge no other set back variances to the zoning
provisions have been requested or granted along this section
of SR 682.
Any "hardship" claimed by the applicant is that of his own
selection. Information available to me indicates that the
applicant obtained title to the property on 10 July 1990.
Both zoning provisions and the topography applicable to and
descriptive of this property are the same now as they were
when the applicant decided to obtain this site.
