The satellite antennae (dishes) located on the subiect
property are receiving television programming from
various satellite transponders located in a geosynchronous
orbit some 2 . 500 miles above the earth ' s equator . At the
specific location in which the satellites orbit , their speed
and the speed of the rotation of the earth is the same .
Therefore , stationary antennae , like those in use by
Adelphia, can track the satellites and continuously receive
broadcast signals from them.
In order to remain sited on the desired satellite , the
antennae must be mounted in such a fashion as to prohibit
movement . The two larger dishes on the property are mounted
in cubes of concrete which are 6x6x6 feet . The smaller
dishes are mounted in smaller anchors of concrete .
The property on which the Adelphia receiving site is located
is surrounded by trees . In their present location . the
antennae have a look angle to the satellite arch which passes
above the trees . To be effective, the look angle must be
unobstructed .
Were Adelphia to move the several dishes further inward
toward the center of the property, several negative
occurances would result :
. .New, expensive concrete cubes would have to be constructed
prior to movement of the dishes by crane .
. . Service interruption would result to all cable subscribers
during periods while the dishes were being moved .
. .As the dishes move to the center of Adelphia ' s
property, they become closer to the trees on adjoining
property. As this occurs, the look angle from the dish to
the satellite begins to fall into the treetops which causes
interference in the reception of the television signals . As
the trees grow, the ability to use the site for reception
would eventually be obliterated.
. .Movement of the dishes from the site would result in
significant design changes and rebuild of the cable
tv system because the site serves as a hub for distribution
of signals into some 500 miles of cable tv plant .
. .The tower located on the property is equipped with antennae
necessary for the reception of "off-the-air" broadcast
television signals from various television stations .
Extensive signal searches were conducted prior to the
choosing of the subject site simply because the signals are
not readily received throughout the Albemarle County area .
This is evident by the lack of reception provided by roof-
top antennae on homes in the area . Because of zoning
requirements , land availability, signal reception,
necessary transportion trunk-line construction, and
reconstruction of the headend facility, an
acceptable alternate site will be extremely difficult
to locate . Even if found, the subscribers in
Charlottesville and Albemarle County would experience many
service outages during the construction and moving of the
facility. The loss of some off-the-air services could
result because of the inability to receive all signals now
carried at all other potential locations . Certainly
citizens of AlbeIncarle and lhai- lotteaville mould face
increased cable tv rates should Adelphia be required to
relocate the previously licensed site . The consumer will
ultimately pay for all services provided . A move of the
magnitude discussed here would have a significant impact
on the rate base for cable tv service .
Adelphia requested the variance from the set-back
requirements since the licensed site had existed in its
present relative state for nearly 10 years prior to
Adelphia ' s purchase of the cable tv system; and. as has been
stated, Adelphia ' s cable tv subscribers in the area will face
economic harm and annoying service interruptions should
Adelphia be required to locate , if possible, another site
and relocate its facilities thereon.

Dear Mr . Rooker :
Provided that Multi-Channel TV Cable Company d/b/a
Adelphia Cable Communications is granted legal authorization
and proceeds with planned improvements outlined in AP-90-05
and VA-90-68 as filed with the Department of Zoning of
Albemarle County, we have agreed to the following:
1 . Permanently remove the street light from its
property and will seek Professor Khare 's approval of any
further exterior lighting to be done on Adelphia ' s property
known as TM .45 , Parcel 16A .
2 . To put in Adelphia ' s final plans provisions for
Adelphia ' s proposed new building to be •a color of green .
Also, provisions will be made to redo the exterior of the
existing building a color of green .

apart along the northern bo der of Adelphia ' s property and
the southern border of Prof -sor Khare ' s property . This work
