Dear Mr. Lushbaugh:
This letter is to inform you that on November 13 , 1990, during the
meeting of the Albemarle County Board of Zoning Appeals, the Board
approved your request for VA-90-72 , subject the following
conditions:
1) Maximum height not to exceed (6) six feet;
2) Sign face limited to 18 square feet;
3) Variance granted for the Elks Lodge only and not transferable
to new occupant,
4) Low glow type lighting be used with a timer that will go off
at midnight, and
5) Approval from Architectural Review Board required.
This variance approval allows relief from Section 4 . 15 . 3 . 2 of the
Albemarle County Zoning Ordinance to increase the size of an
identification sign from 2 square feet to 18 square feet, a
variance of 16 square feet. Since the sign will meet the setback
requirement of 25 feet, the setback request was withdrawn.

ACREAGE: 1. 5 Acres
LOCATION: Southwest quadrant of Route 20 north and Elks
Drive.
REQUEST:
The applicant requests relief from Section 4 . 15. 3 . 2 and 13 . 3 of
the Albemarle County Zoning Ordinance, which states:
"4 . 15. 3 .2 Residential (R-1)
Identification Signs: Provided:
a) Not more than (2) square feet in area; "
"13 . 3 AREA AND BULK REGULATIONS,
Yards, minimum:
Front. . . 25 feet. "
The applicant is requesting a variance to increase the area of an
identification sign from 2 squa e feet to 18 square feet, a
variance of 16 square feet. The applicant is also requesting a
variance to reduce the setback from the Route 20 north
right-of-way from 25 feet to 5 feet, a variance of 20 feet The
sign will be an aluminum bronzetone cabinet with white background
mounted on a 2 foot by 6 foot dryret base (stucco) . The logo and
copy will be blue on a white background. Lighting can be
accomplished by two alternatives: (1) Internal illumination with
fluorescent lamps. (2) Indirect illumination may be provided by
ground flood lights.
The applicant's justification includes:
1. The Elks lodge is often used to host a number of civic and
charitable events.
2 . The lodge is also used for private functions, such as weddings,
anniversaries and reunions, etc.
3 . Since the improvements to the entrance road to Rivanna Park
have been completed it has become more difficult to see the
entrance at night.
4 . The lodge is used as polling location for the residents of the
Rivanna District.
5. A (2) square foot sign at a 25 foot setback would be
practically useless and almost impossible to read at the
posted highway speed of 55 miles an hour.
6. The lodge's primary concern is to insure and protect the safety
of those individuals trying to locate our facility.

RECOMMENDATION:
As the Board is aware, Zoning staff is reviewing and rewriting the
County sign regulations. Should these regulations be approved,
staff's recommendation to the Board of Supervisors is follows:
Non-residential uses in a residential area: Churches, lodges,
clubs, fraternal, patriotic organizations, fire and rescue squads,
Hospitals:
Size: Limited to 24 square feet.
Height: 6 feet to 8 feet.
Setback: 10 feet, may be reduced to 5 feet with proper sight
distance.
Type: Monument or pedestal design.
Lighting: Not completely determined, however, indirect lighting
is recommended.
The current proposal by the applicant will meet the criteria
recommended by staff at this time. Therefore, staff recommends
approval for cause.
Should the Board find cause to grant this variance request, staff
would offer the following conditions:
1) Maximum height not to exceed (6) six feet.
2) Sign face limited to 16 square feet.
3) Variance granted for the Elks Lodge only and not transferable
to new occupant.
4) If additional right-of-way is required at a later date, the
applicant will relocate sign at its own expense.
