Box 528 Charlottesville, Virginia 22902 804-296-6015 September 27, 1990 Mr. John Grady Deputy Zoning Administrator County of Albemarle 401 McIntire Road Charlottesville, VA 22901-5875 Re: Application for variance-B.P.O.E.#389 Dear Mr. Grady: Reference is made to our on-site meeting of September 12 , 1990,and your letter of September 13, 1990. Enclosed herewith is a completed application for Zoning Variance, a check for $65. 00 as fee for same, a copy of our plat indicating the proposed location of the sign, a sketch of the proposed sign, and several photographs of the area. Regarding this request for the variance, there are several factors which we feel need to be considered. In total, we feel that they are solid justification for the granting of the variance. The Elks Lodge property is often used to host a number of civic and charitable events and/or meetings, including Volunteer Fire Department dances and fund raisers, Charlottesville-Albemarle Rescue Squad events, Martha Jefferson Hospital Auxillary Bazaars, Ducks Unlimited events, etc. In addition to these events, our facilities are used as a Polling Location for the residents of the Rivanna District. Our facilities are often used for private functions sponsored by our members, such as weddings, retirement parties, anniversaries, picnics, reunions, etc. Since the Rivanna Park was constructed and improvements were made to Elk Drive and Rt. 20, it has become very difficult to see the entrance to Elk Drive at night. This is due to the fact that Rt. 20 was widened, and vehicles travelling north are placed about 30 feet further away from the entrance to Elk Drive. This area does not have street lights, and is very dark at night. Often times, members and guests complain that they had passed Elk Drive before they saw it. They then have to find a place to turn around and come back. This obviously causes a dangerous situation on an already treacherous piece of road. Mr. John Grady September 27, 1990 Page 2 Our request to place a sign where it can be seen far enough in advance to alert the driver of the entrance will create an identifiable landmark for those looking for our facility, as well as the Rivanna Park. Without a variance, the sign would not be visible in time to make a safe turn into Elk Drive. The existing terrain would block a sign placed 20 feet away from the road right of way. We also feel that a small (2 sq.ft. ) sign would be practically useless, since it would be impossible to read at the posted highway speed of 55mph. As you will note from the enclosed sketch, the sign has been designed with careful consideration to preserving the beauty and integrity of the area. Interior illumination (flourescent) has been chosen for its "soft" effect and virtual elimination of glare. Since other properties in the area are primarily residential, they do not suffer the same hardship that this zoning regulation creates. However, we do not feel that the granting of this variance will change the character of the area, since our grounds are professionally maintained in a "park" or "estate" like condition, and most "estates" in the area have some sort of sign at their entrances. As stated above, our primary concern is to insure and protect the safety of those individuals who are trying to locate our facility, and the entrance to Elk Drive which also serves the Rivanna Park. Therefore, we believe that the granting of this variance will be in the public interest.
