Dear Mr. & Mrs. Carter:
This letter is to inform you that on November 20, 1990 , during the
meeting of the Albemarle County Board of Zoning Appeals, the Board
approved your request for VA-90-73 .
This variance approval allows relief from Section 10. 4 to allow an
addition to be built 39 feet from the right-of-way of Route 635,
a variance of 26 feet.

OWNER/APPLICANT: Mr. and Mrs. Arthur and Dorothy Ca -ter
TAX MAP/PARCEL: 85-27F
ZONING: RA, Rural Areas
ACREAGE: .860
LOCATION: South side of Route 635 approximately one-half mile
west of Batesville
REQUEST: The applicants request relief from Section 10. 4, "Area and
Bulk Regulations" , of the Albemarle County Zoning Ordinance, which
states:
Yards, minimum: Front 75 feet
The applicants request a variance of 36 feet in order to build an
addition to their home 39 feet from the right-of-way of Route 635.
The applicants offer the following justification for their request:
1. The addition is needed to enlarge two small bedrooms on the
existing house.
2 . The septic system located near the back of the house
prohibits building the addition there.
3 . The addition will be no closer to Route 635 than the
existing house.
RELEVANT HISTORY: The house was built in 1965 before the County had
adopted a Zoning Ordinance.
RECOMMENDATION: Since the addition will be no closer to Route 635 than
the existing house, it is staff's opinion that this request satisfies
the third criteria for approval :
3 . The applicant has provided evidence that the authorization
of such variance will not be of substantial detriment to
adjacent property and that the character of the district
will not be changed by the granting of the variance.
Nevertheless, staff believes that the applicants currently enjoy a
reasonable use of their property and recommends denial for cause:
1. The applicant has not provided evidence that the strict
application of the ordinance would produce undue hardship;
2 . The applicant has not provided evidence that such hardship
is not shared generally by other properties in the same
zoning district and the same vicinity.
Should the Board approve this request, staff recommends the following
condition:
1. This variance shall be only for the addition described as
part of the application for VA-90-73 , an addition on the
west side of the building and measuring 29 x 20 feet.
