CRAIG ASSOCIATES, INCORPORATED, and Montagu H. McMurdo . Source of Title: The property shown on the plat as Area Dedicated by M. H. ' McMurdo was conveyed to him by deed of Doris H. McMurdo, dated September 5, 1946, of record in the Clerk' s Office of the Circuit Court of Albemarle County . ' Virginia, in Deed Book 270 page 392. The area owned by CRAIG ASSOCIATES, INCORPORATED, which consists of all of Block F, Lot 1 in Block G, as well as the roads therein, was conveyed to CRAIG ASSOCIATES, INCORPORATED, by deed of ALCOVA ASSOCIATES, INCORPORATED, dated July 31, 1961, of record in said Clerk' s ! Office in Deed Book 370 page 339. The balance of the property shown on said plat, being certain lots in Blocks A and D in Section One were conveyed to ALCOVA ASSOCIATES, INCORPORATED, by deed of ALBEMARLE COUNTY RESEARCH CORPORATION, by deed dated July 16, 1959, of record in the Clerk' s Office aforesaid in Deed Book 352 page 509. DEDICATION: • In addition to the roads and streets which are hereby tendered for dedication to public use, the area shown on said plat as PARK 2.92 AC is hereby idedicated as a park to be used by all of the owners of lots in "Key West" ! subdivision, but such dedication shall not be deemed a dedication to said lot owners to use any of the improvements such as swimming pools, tennis courts, etc. which may be erected on the said park area. RESTRICTIONS: (being same restrictions set forth with deed in D. B. 370 p. 339) The following restrictions shall affect only those lots in Section Two as shown on said plat, specifically Lots 1 thru 17 in Block F and Lot 1 in Block G, but shall in no way be considered imposed on any Lots in Section One, and as to said Lots in Section Two, these restrictions shall, together with the easements therein, be considered covenants running with the land: 1. No shop, store, trailer , temporary living structure, factory, hospital, asylum, institution, tourist home or business house of any kind, and no apartment houses, other than as hereinafter provided, shall be erected or maintained on said property, and said property shall be used solely for a single family residence, except as hereinafter provided . 2. (a) The restriction against the erection or maintenance of apartment houses, as set out in paragraph 1 above, and likewise the restriction that the property be used solely for single family residences, shall not prohibit the erection, construction and maintenance of duplexes and two family dwellings , on any lot, but the plans for the exterior design, material, location on lot, 471 and type of construction of any such duplex or two family dwelling shall first be subject to the final and absolute approval or disapproval of an Architectural Control Committee composed of ALCOVA ASSOCIATES, INCORPORATED, and CRAIG ASSOCIATES, INCORPORATED, and in the event that said Architectural Control Committee is unable to agree, it shall appoint a third mutually acceptable party, which third party shall render a final decision as to the approval or ;disapproval of any such duplex or two family dwelling . 3 . (a) The exterior design, material, grading plans, location Ion the lot, and type of construction of any home, residence or other building , for alterations or additions thereto, shall, except as to duplexes and two I ( family dwellings provided for in paragraph 2 above, before the beginning of any work thereon, be submitted by registered mail to CRAIG ASSOCIATES, INCORPORATED, ITS successors or assigns, for approval. If said plans are not disapproved within the said thirty days from the date when they are mailed to said CRIAG ASSOCIATES, INCORPORATED, its successors or assigns, the said plans shall conclusively be presumed to have been approved. 4 . If, as provided in paragraph 2 above, the said Architectural Control Committee, or its appointee shall fail to approve or disapprove plans which may be submitted to it within a period of sixty days from the time they are submitted, they shall conclusively be presumed to have been approved . 5 . If no legal action with respect to a breach of any of the covenants set out in paragraph two, three and four, above, shall have been commenced and no notice of lis pendens with respect thereto recorded in the appropriate Clerk ' s Office within sixty days after completion of such home residence, duplex, two family dwelling, or other building, or alterations or additions thereto, it shall conclusively be presumed that there has been full compliance with this provision. 6. CRAIG ASSOCIATES, INCORPORATED shall reserve for itself, its successors or assigns, a permanent easement across the rear and both sides of each lot when subdivided, within six (6 ) feet of such boundaries for the carrying of utilities or sewage and for the necessary maintenance of such facilities. 7. No part of any lot, after said subdivision has been made, shall be used for a roadway as access to any property lying outside of the boundaries of Key West Subdivision, unless CRAIG ASSOCIATES, INCORPORATED, its successors or assigns, shall first give written consent. 8 . Any building which may be erected on any lot or further subdivision Hof any lot shall be so placed that no portion thereof, except porches or verandas, k shall be nearer to the road or street upon which it faces than 35 feet. In the ' case of lots having frontage on two roads or streets , however, the set-back shall be 35 feet from the road along which the lot has the shorter frontage, land 25 feet from the other road . No building nor any part thereof, including porches and verandas, shall be nearer than ten (10) feet to any adjoining lot line. 4172 9. (a) No lot shall contain less than 18,000 square feet and ; no lot as shown on said subdivision plat once put to record, shall be further subdivided without the written consent of CRAIG ASSOCIATES, INCORPORATED, its successors or assigns . (b)-1 No single story dwelling erected on any lot shall contain in the main structure less than 1200 square feet of ground floor area, exclusive of breezeway, open porches, basement, carport, and garage. (b)-2 No one and One-half (1 1/2) story dwelling erected on any lot shall contain in the main structure less than 900 square feet of ground , floor area exclusive of breezeway, open porches, basement, carport, and garage, nor less than 450 square feet of usable floor area on its second floor . (b)-3 No two (2) story dwelling erected on any lot shall contain ' in its main structure less than 900 square feet of ground floor area exclusive of breezeway, open porches, basement, carport, and garage, nor less than an aggregate of 1800 square feet of usable living area on its first and second ' floors. 10. No building materials, refuse, junk, trucks, commercial ;vehicles, or passenger vehicles in excess of two shall be kept or stored on ' any lot other than during the course of construction of buildings or additions to buildings on such lot and required for such construction, unless housed in ' a suitable structure erected on the lot. j 11. Except for those lots which may have one or more boundary • lines, or portions thereof, located in or running through the bed of a pond, no lot, or owner or owners thereof, shall have any rights to the use or enjoyment of any such ponds . 12. The term successors or assigns as used in these restrictive covenants, shall mean the successors or assigns of CRAIG ASSOCIATES, INCORPORATED, ; as subdivider , and shall not be construed to include the individual owners of the several lots in the subdivision when said subdivision is put to record . Blodin- ger &c Trustees the Clerk' s Office of the Circuit Court of Albemarle County, Virginia, in Deed To: Release Book 370 page 343, Craig Associates, Incorporated, conveyed to Robert H. ; Craig Associates Blodinger and Orbin F. Carter, Trustees , a tract of land located in Albemarle Incorporated County, Virginia, and therein described, and Fee Pd . $3 . 50 r � WHEREAS, said deed of trust referred a Subdivision Plat of Section Two and Revisions in Block A & D in Section One "Key West" , said Section Two being the land actually secured by the deed of trust, and WHEREAS, said deed of trust further provides that Craig Associates, Incorporated, may request a release of any 12 lots as shown on said plat at any time, and that the trustees shall by their sole and separate act, without requiring the signature of the noteholder, release any of said lots belonging to Craig Associates ; Incorporated, and secured by said deed of trust when so requested, and WHEREAS, said plat has now been recorded and Craig Associates, Incorporated, desires a release of certain lots as hereinafter set out, NOW THEREFORE, this Deed of Release, made this 14th day of September, 1961, by and between Robert H. Blodinger and Orbin F. Carter, Trustes, hereinafter referred to as the Trustees , and Craig Associates, Incorporated, hereinafter referred to as the Grantee, WITNESSETH: Li That for and in consideration of the sum of Ten Dollars ($10.00) cash and other valuable consideration, receipt of which is hereby acknowledged by the Trustees, the said Trustees do hereby GRANT, RELEASE AND CONFIRM with special Warranty of title, unto CRAIG ASSOCIATES, INCORPORATED, freed and discharged from the lien of a deed of trust dated July 31, 1961, of record in the Clerk' s Office of the Circuit Court of Albemarle County, Virginia, in Deed Book 370, page 343, the following lots or parcels of land, to-wit: "all those certain lots located in the Charlottesville Magisterial District of , Albemarle County, Virginia and shown and described as Lots 2, 3, 5 , 6, 10, 11, '. 13, 14, 15, 16, 17, in Block F; and Lot 1, Block G, on a plat of Section Two and Revisions in Blocks A and D "Key West" by William S. Roudabush, Jr . , dated June, 1961, recorded in said Clerk' s Office immediately preceding this deed . And the said Trustees further GRANT, RELEASE, and CONFIRM, with SPECIAL WARRANTY OF TITLE unto CRAIG ASSOCIATES, INCORPORATED, free from the lien of said deed of trust, all of the roads and streets as shown on said plat which may be affected by the lien of said deed of trust, and also the area described on said plat as PARK 2.92 AC, the authority for said Trustees to release the roads and park, having been specifically provided for in the deed of trust as aforesaid . The property hereby released is a portion of the same property which was conveyed to CRAIG ASSOCIATES, INCORPORATED, by deed of ALCOVA ASSOCIATES, INCORPORATED, dated July 31, 1961, of record in said Clerk' s Office in Deed Book 370 page 339.
