As agent for the owner, Mr. John Eckman of J & F Eckman, Inc., we respectfully submit these for consideration during hearing of the matter. 1. In review of the Comprehensive Plan (1988-2010) it appears that this site lies within the proclaimed "Village of North Carden". As one of the three existing commercial retail structures, and one which has been in operation since the 1940's, improvements are necessary. The plan calls for the area to be of low density residential with small scale retail support. Improvements of this small magnitude, to the existing retail structures seem to fit well with the plans for the area. 2. The improvements, shown on this plan, do not represent a change or increase in use; rather, a service to patrons. As with any canopied service, protection from the natural elements is a major complement. However, there are more, often overlooked factors which should be realized. One of which is lightening and electrical catastrophe protection of the pumps; another is the opportunity for concentrated area/security lighting which is shielded from both adjacent residential areas as well as roadway traffic. 3. As mentioned in section 1 above the Comprehensive Plan details this general area for growth. As with any growth area, traffic allowances must be planned for as the County has demonstrated in calling for improvements to the intersection of U.S. Rt. 29 and S.Z. 710. The writer has spoken with VDOT officials regarding this site and no improvements are slated for the area within the Six Year Plan or evident beyond that. Our planning sketches show that the Northbound lanes of U.S. 29 could be expanded to 4 lanes (2 travel and 2 decel. or 3 and 1) with no additional acquisition necessary from this parcel. Likewise a proportionate expansion is possible on S.R. 710. It should be noted that acceptance of even a 74' variance, would position the structure some 80' from the centerline of U.S. 29 and some 100' from the centerline S.R. 710. 4. It is important to recognize that this proposal is necessary due to the physical attributes of the property and it is arguable that the property should be rezoned to properly enhance its use. However, the applicant at this stage of the community's maturity is seeking only to meet its current needs. Your assistance in this matter is appreciated. (x)Ferelt, (i 1 jimmy L.
