VIRGINIA 22901 (804) 295-1183 Ms. Amelia Patterson Zoning Administrator County of Albemarle 401 McIntire Road Charlottesville, Va. 22901-4596 Dear Ms. Patterson: I would like to register my opposition to the variance request by Mr. Edward Strauss, for property described as Tax Map 69B, Parcel 57. Please excuse my absence at the public hearing before its Board of Zoning Appeals. The meeting is very important to me, but, as I told you, I have an appointment, of long standing, in Washington, which I don't feel I can change. I own the 50 acres behind Mr. Strauss' house, served by the private right of way in question today. At the present time, I am using the land as a tree farm for Ivy Nursery. There is, however, an approved subdivision plan dividing the acreage into 22 lots. At some point in the future, or in my retirement, I might need to sell these lots. The side of Mr. Strauss' house is 42' from the right of way and his parking area is between the house and the right of way, placing it very close to the right of way. I feel that this proximity to the right of way pinches the entrance to my 22 lots and takes away from an attractive entrance to my lots. I would like to make the following proposal for solving this problem. Proposal 1: Is it possible to grant a variance so Mr. Strauss' driveway could come directly from Rte 690 and up to the side of the house opposite the right of way? That way, the 42' would be lawn area, which would be much more attractive for my entrance. Proposal 2: If the first proposal is not possible, could Mr. Strauss park either in front of or behind his house, i.e. outside of the 42' setback from the right of way? Also, could the garbage cans be placed outside the 42' setback? If this can be done, I will withdraw my opposition to the variance request. Thank you for presenting this letter to the Board.
