COUNTY OF ALBEMARLE, VIRGINIA - Application for Variance
Townside East Limited Partnership
Justification for Request:
1. It is desired to obtain a more flexible and simple method of
administration as the various tenant spaces are leased. In the case
of the current zoning, the required number of parking spaces have been
met in accordance with the methods required by the zoning ordinance.
The required spaces are 157 including 4 which are for the physically
handicapped.
2. As each area is leased, the individual ratio of public use space
as opposed to storage/work space is applied to the parking requirement
formula . From this an everchanging parking requirement emerges.
This creates a complexity of required paperwork both for the owner as
well as the county. In order to reduce this problem, the constant
parking requirement method of calculation called for in a planned
development shopping center zoning would simplify the process
considerably.
3. In order to comply with PD-SC zoning it will be necessary to
obtain a 35 space variance. It is believed the request for the
variance is justified because of the urban location of Townside. It
has been conservatively estimated there is, in the immediate area, a
population of approximately 3000 people who, due to the proximity of
the center, will be pedestrian patrons.

Dear Ms. Patterson:
This letter is intended to inform you of our objection to granting Townside
East Limited Partnership the variance they are requesting that alloys them to reduce
the parking requirments from 192 to 157 spaces.
Such changes will directly effect us the most. this is not a case of one or
two parking spaces short, it is 35 parking spaces, a 22% of parking requirment. That
is a substantial amount of parking space.
In actual reality, this can mean that on a given day, a 35 cars can be wondering
around looking for a parking space in a. saturated lot, and thier next best alternative
would be to use the " Newly constructed conuun intrance" and to use our parking lot for
their purpose, a situation must be avoided, and I believe The county has an obligation
to protect the property rights of it's citizens.
Finally and for the records I want to state that as of this date I do not
have a legal representative to present my case during the upcorrming public hearing
on January 8, 1991. I trust that our absence from the public hearing will not be
interpreted as lack of interest.
