Sheridan Rt. 2 , Box 383 Crozet, VA 22932 RE: Board of Zoning Appeals Action VA-90-86 Tax Map 26, Parcel 33B Dear Mr. Sheridan: This letter is to inform you that on January 8 , 1991, during the meeting of the Albemarle County Board of Zoning Appeals, the Board unanimously approved your request for VA-90-35 subject to the following conditions: 1. County Engineer approval of a method of alerting motorists to the building location, and of providing a barrier if necessary, 2 . The edge of the road travelway may be no closer then 5 feet to the building, and 3 . County Engineer approval of safety measures for pedestrians exiting the building. This variance approval allows relief from Section 10. 4 to reduce the front setback from an existing building to a proposed subdivision road from 75 to 0 feet. Patterson Zoning Administrator AMP/s t cc: VA-90-86 Inspections Department Planning Department STAFF PERSON: Amelia Patterson PUBLIC HEARING: January 8, 1991 STAFF REPORT - VA-90-86 OWNER/APPLICANT: Phillip and Mary Sheridan/Montfair TAX MAP/PARCEL: 26/33B ZONING: Rural Areas with SP-86-79 ACREAGE: 67 .55 acres LOCATION: On the north side of Rt 673, 1/4 mile from Rt 810. REQUEST: The applicant requests relief from Section 10. 4 of the Albemarle County Zoning Ordinance, which states: "Section 10. 4 AREA AND BULK REGULATIONS Yards, minimum Front 75 feet" The applicant seeks a variance to reduce the front setback from an existing building to a proposed subdivision road from 75 to 0 feet. The property is proposed for a rural preservation development of 20 lots, which is pending this variance outcome. The building is currently used as the campground office and store. It is proposed for an office and security post for the proposed residential subdivision. The applicant's justification includes: 1) The building is approximately 25 years old. It still has a useful life. 2) The road exists. The upgraded road location is constrained by the existing tennis courts and this building. There does not appear to be a more appropriate road location. RELEVANT HISTORY: Staff recognizes that each variance is reviewed on its own merits, and is not on its face precedent-setting. The following history is provided for information: There is no variance history. Prior special permits have been granted for the campground (existing) and the golf course (proposed) . Page 2 Staff Report - VA-90-86 RECOMMENDATION: The building and road have been shown on prior plans, including the golf course plan in SP-86-79 . It is only with the design of this subdivision and roadway that we were aware of this setback problem. The building will be approximately 5 feet from the edge of the road travelway. The options could include: 1. Move or remove the building; 2 . Remove the tennis courts and shift the road; or 3 . Significantly realign the road. Of these, removal of either the building or the tennis courts appears most practical. However, because the building and road exist, it seems most practical to grant the variance. The building is not historically or structurally significant. It is reasonable to foresee some future use for this building, given the proposed development. The road will be relatively low speed and low volume. Staff recommends County Engineer review to determine if reflectors, guard rails and the like, would be a safety measure. Staff recommends approval for cause: 1. The applicant has provided evidence that the strict application of the ordinance would produce hardship; 2 . The applicant has provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity; 3 . The applicant has provided evidence that the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. Staff recommends the following conditions: 1. County Engineer approval of a method of alerting motorists to the building location, and of providing a barrier if necessary. 2 . The edge of the road travelway may be no closer than 5 feet to the building.
