Dear Mr. and Mrs. Wood:
This letter is to inform you that on February 12 , 1991, during the
meeting of the Albemarle County Board of Zoning Appeals, the Board
unanimously approved your request for VA-91-01, subject to the
following conditions:
1. Variance is limited to the 14 X 36 foot addition described
in the application, no portion of which shall be closer than
19 feet to the side property line;
2 . Addition must be completed within 12 months of approval .
This variance approval allows relief from Section 10 . 4 of the
Albemarle County Zoning Ordinance to reduce the side setback from
25 to 19 feet for an addition to a house.

OWNER/APPLICANT: Mr. Carlton E. and Joyce R. Wood
TAX MAP/PARCEL: 30-22E
ZONING: RA, Rural Areas
ACREAGE: 5. 9 acres
LOCATION: Route 660, across from Mallard Lake subdivision
REQUEST: In order to build a 14 x 36-foot addition 19 feet from a
side property line, the applicant requests relief from Section
10. 4 of the Albemarle County Zoning Ordinance, which states:
Yards, minimum: Side, 25 feet.
The applicant' s justification includes the following:
1. The existing house, measuring 676 square feet, is too
small.
2 . The layout of the existing house makes this addition the
most practical location.
3 . Adding the proposed wing would improve the appearance of
the house, making it more compatible with the character
of the district.
4 . Placing the entire addition onto the back of the house
would require the removal of a fence and several large
hardwood trees.
RELEVANT HISTORY: The house was built in 1961.
RECOMMENDATION: Staff agrees that the addition would satisfy the
third condition of approval:
3 . The applicant has provided evidence that the
authorization of such variance will not be of substantial
detriment to adjacent property and that the character of
the district will not be changed by the granting of the
variance.
Staff also agrees that prohibiting any addition to the existing
house would constitute a hardship due to the small size of the
existing house. However, it is possible that the applicant could
build the proposed addition onto the back of the house without
requiring a variance, although staff agrees that the addition as
proposed would better complement the lines and layout of the
existing house and preserve the hardwoods noted earlier.
Staff recommends denial for cause:

1. The applicant has not provided evidence that the strict
application of the ordinance would produce undue
hardship; and
2 . The applicant has not provided evidence that such
hardship is not shared generally by other properties in
the same zoning district and the same vicinity.
Should the Board approve this request, staff recommends the
following condition:
1. Variance is limited to the 14 x 36 foot addition
