This variance approval allows relief from Section 10 . 4 of the Albemarle County Zoning Ordinance to reduce the front setback from 1) Route 668 from 75 to 34 feet and from 2) a private road from 75 to 42 feet, for addition to a storage building. Sincerely, Jo n Grady Deputy Zoning Administrator JG/sg • STAFF PERSON: John Grady PUBLIC HEARING: February 12 , 1991 STAFF REPORT - VA-91-02 OWNER/APPLICANT: Hobart Shiflett TAX MAP/PARCEL: 14/52B ZONING: Rural Areas ACREAGE: 2 . 34 acres LOCATION: On the north side of Route 668, approximately 2/10 mile east of Route 810. REQUEST: The applicant requests relief from Section 10. 4 and 4 . 6. 3 .2 of the Albemarle County Zoning Ordinance, which states: "10. 4 AREA AND BULK REGULATIONS yards, minimum: front 75 feet" and "4 . 6. 3 . 2 other yards adjacent to streets shall have a minimum depth, equal to the minimum front yard depth required in the district in which the lot is located. . . " The applicant requests a 41 foot variance from the right-of-way of Route 668 and a 32 foot variance from the outside edge of an existing 15 foot private road. The purpose of the variance request is to construct a 10 foot X 14 foot (140 square feet) addition onto an existing storage shed. The proposed addition will be 34 feet from Route 668 and 43 feet from the 15 foot private road. The applicant's justification includes: 1. The existing shed was built over 30 years ago. 2 . The proposed addition will be no closer to Route 668 than the existing shed. 3 . The 15 foot right-of-way serves no other property owner or residence. 4 . The addition will not be a detriment to adjacent property nor will it change the character of the district. The existing house and the storage shed was built before the County adopted a zoning ordinance. Staff Report - VA-91-02 Page 2 RECOMMENDATION: Staff agrees with the applicant that the addition will not alter the character of the district nor will it be a detriment to the adjacent property. However, staff finds that the applicant does not meet the criteria listed below for approval and the applicant does enjoy reasonable use of his property. Therefore, staff recommends denial for cause. 1. The applicant has not provided evidence that the strict application of the ordinance would produce undue hardship; 2 . The applicant has not provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity.
