This letter is to inform you that on February 12 , 1991, during the
meeting of the Albemarle County Board of Zoning Appeals, the Board
denied your request for VA-91-07 .
Anyone aggrieved by a decision of the Board can appeal their
decision to the Circuit Court of Albemarle County within thirty
(30) days of the decision.

RE: Variance Request for Stop In Food Stores
Planning staff has reviewed the variance application for the
above referenced project and can offer the following
comments:
1. The proposed improvements to Route 29 have a limited
impact on the location of the right-of-way. However,
entrance locations will be modified. I have been
informed by VDOT that more detailed plans are being
prepared. I am unable to determine at this time the
full impact of the Route 29 improvements to this site.
2. The proposed fuel island will restrict available
travelways due to its proximity to the entrance and
Route 29 and may result in onsite congestion which may
block the entrance to Route 29 and possibly Route 29
itself. Therefore, the Planning staff is unable to
support the request for an additional fuel island.

OWNER/APPLICANT: Whiting Oil Co. , Inc.
TAX MAP/PARCEL: 61W-03-12
ZONING: C-1, Commercial
ACREAGE: .75 +/-
LOCATION: The southwest quadrant of Route 29 and
Greenbrier Drive.
REQUEST:
The applicant requests relief from Section 21. 7 . 1 of the Albemarle
County Zoning Ordinance, which states:
"21. 7 . 1 Adjacent to public streets: No portion of any structure
except signs advertising sale or rental of the
property shall be erected closer that thirty (30) feet
to any public street right-of-way. . . "
The applicant requests a 10 foot variance in order to construct an
additional fuel dispensing island 20 feet from the existing
right-of-way of Route 29 . The dispensing island will be 40 feet X
4 feet and will contain 6 dispensing units.
The applicant's justification includes:
1. The additional island will distribute traffic more efficiently
and safely.
2 . Variance is needed to allow proper spacing between existing
island and proposed island.
3 . The proposed dispensing island will be removed at our expense
when the Route 29 base case improvements are made. (This has be
stipulated by the application letter) .
RECOMMENDATION:
The stop-in site currently provides six (6) pumping stations under
the canopy. The existing area allows six (6) vehicles to be
serviced at the same time. To add additional dispensing island
capable of servicing six (6) additional vehicles on this site may
cause congestion and stacking of vehicles as they enter the site
from Route 29 on Greenbrier Drive. A site plan and architectural
review will be required. It is staff's opinion that no hardship
exists in this case. The applicant currently does have reasonable
use of the property. Furthermore, staff is concerned that the
proposal would overdevelop the site and create traffic congestion
onto the adjoining primary and secondary public roads.

Staff recommends denial for cause:
1. The applicant has not provided evidence that the strict
application of the ordinance would produce undue hardship;
2 . The applicant has not provided evidence that such hardship is
not shared generally by other properties in the same zoning
district and the same vicinity;
3 . The applicant has not provided evidence that the authorization
of such variance will not be of substantial detriment to
adjacent property and that the character of the district will
not be changed by the granting of the variance.
Should the Board find cause to approve this application staff
recommends the following conditions:
1. Should the island have to be removed for future improvements
along Route 29 it shall be at the owners expense.
2 . Should this site at a future date be substantially cleared and
rebuilt this variance application shall be null and void.
