Subject: SUB201900070 Parcel W — Worrell Land Development LC — Two -Lot Subdivision Plat
The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above
once the following comments have been addressed: [Each comment is preceded by the applicable reference,
which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
[14-302 (13)(5)] Revise the Zoning District classification notes at the bottom of Sheet 1 as follows:
a. State the correct TMP number, TMP 78-20C. Rev. 1: Comment addressed.
b. State that the property is subject to the approved proffers and conditions of the following
applications: ZM1996-03, ZMA2001-15, SP 2000-06, SP2001-56, SP2001-57. Rev. 1:
Comment partially addressed. Staff made an error in the first review comments, ZMA2001-15
does not apply to TMP 78-20C. Please remove reference to ZMA2001-15 in the note on Sheet
1. Rev. 2: Comment addressed.
c. Add a note stating what Zoning Overlay Districts will apply to new Parcel W. According to
Albemarle County GIS, it appears that the new parcel may contain areas designated as
Preserved Steep Slopes Overlay District. Please verify whether this is true, and if so, add a note
to Sheet 1. Rev. 1: Comment addressed.
d. If new parcel W is within the Preserved Steep Slopes Overlay District, show the boundaries of
the overlay district on Sheet 2. Rev. 1: Comment addressed.
2. 114-302 (13)(5)] Remove the note on Sheet 1 referencing the AIA Overlay District. Rev. 1: Comment
addressed.
3. [General Comment] Remove the note at the bottom of sheet 1 regarding "subsequent divisions of the
residue shall enter onto such streets..." Rev. 1: Comment addressed.
4. [14-302 (B)(1)] Add a date of last revision to each sheet. Rev. 1: Please add a date of last revision to
each drawing. Rev. 2: Please add a date of last revision to each drawing.
5. [14-302 (13)(8)] Please show the location of all required yards (setbacks) on the plat. All setbacks
should be labeled with a measurement and identified as either "Front," "Side," or "Rear" on Sheet 2.
a. Include a note on Sheet 1 stating the minimum and maximum setbacks (as applicable) are for
buildings, parking, etc. Rev. 1: Per ZMA1996-03, the following setbacks apply to this property
Minimum front building setback: 30' adjacent to public streets. 10' adjacent to private internal
streets. Off street parking and loading space minimum front setback: 10'. Please amend the note
on Sheet 1. Rev. 2: Comment addressed.
6. [14-303 (D)] Please state the acreage of each existing lot. Rev. 1: Comment not fully addressed. The
most recently recorded plat for TMP 78-20C, instrument DB 4454 pages 527-535, states that the parcel
acreage is 25.643 acres. The area tabulations on Sheet 3 state that TMP 78-20C currently measures
25.684 acres. Please explain this discrepancy and revise the area tabulations on Sheet 3 as necessga,
and revise the property label acreage for TMP 78-20C on Sheet 2. Rev. 2: Comment not fully
addressed. The labels for the residue of TMP 78-20C on Sheet 2 state that the new total property
acreage is 25.284 acres, but this does not match the calculation on Sheet 3. The residue of TMP
78-20C should equal 25.243 acres. Please revise the label on Sheet 2.
7. [General Comment] On Sheet 2, please revise the label for the new/proposed 50' R/W that will go
over top of Worrell Drive. It should be labeled "New 50' Private Street." Rev. 1: Please add the word
"Easement" after the words Private Street in the label on Sheet 2. Rev. 2: Comment addressed.
8. [14-317] Please submit an instrument evidencing maintenance for the proposed private street being
created over Worrell Drive that complies with all requirements of Section 14-317.
a. A copy of a maintenance agreement template has been provided for your use. Please submit a
draft of the instrument with the next submittal, and this will be forwarded to the County
Attorney for review and approval. Rev. 1: Since the plat will need to be revised to reflect these
comments, the third paragraph of the draft deed will need to be updated so that it states the date
of last revision. Please re -submit an updated version of the maintenance agreement with the
next plat submittal. Rev. 2: Since the plat will need to be revised to reflect these comments,

Additionally, the draft maintenance agreement has been forwarded to the County
Attorney for final review. Further comments from the County Attorney may be
forthcoming. Staff suggests waiting to revise the draft maintenance agreement until the
County Attorney's review is complete.
