Sign area shall not exceed 24 square feet. 2 . Sign shall not be located closer than 25 feet to the existing right-of-way of Route 795. 3 . Sign design and colors shall conform to application and example submitted with variance request. 4 . Sign style, composition and color for future replacement to be approved by the Zoning Administrator. 5 . Sign shall not be lighted. Sincerely, --� - �7 John Grady Deputy Zoning Administrator JG/st cc: Vf'A-91-11 Sign Permit STAFF PERSON: John Grady PUBLIC HEARING: April 9 , 1991 STAFF REPORT - VA-91-11 OWNER/APPLICANT: Stanley Woodward and Sarah Colle (owners) TAX MAP/PARCEL: 92/2D ZONING: Rural Areas ACREAGE: 69 Acres LOCATION: Located on the west side of Route 53 at the intersection of Route 53 and Route 795, known as Simeon Vineyards. REQUEST: The applicant requests relief from Section 10. 4 of the Albemarle County Zoning Ordinance, which states: "10. 4 AREA AND BULK REGULATIONS Yards, minimum front 75 feet" The applicant seeks a variance to reduce the front setback from 75 to 25 feet for placement of a freestanding business sign for the vineyard. The proposed sign will be approximately 7 feet in height and 24 square feet in sign area. It will be constructed of wood with a tan background trimmed and lettered in gold and dark green. The applicant's justification includes: 1. The sign is necessary to provide identification to the general public and service vehicles. 2 . The 24 square foot sign will not be visible at a 75 foot setback. 3 . The requested sign is considerably smaller than what would be allowed at the 75 foot setback. A 100 square foot sign is allowed in this district. Staff Report - VA-91-11 Page 2 RECOMMENDATION: Staff is somewhat sympathetic to the applicant's request. The requested sign is 76 square feet smaller than what would be allowed at the 75 foot setback. The location, style, composition and colors would meet the sign regulations being developed by the Zoning staff. These have not yet been reviewed or approved by the Board of Supervisors. It is also staff's opinion that authorization of this variance would not be of substantial detriment to adjacent property and the character of the district will not be changed. It is the consensus of the Zoning staff that although staff can not recommend approval for this request at this time, the applicants request for the 24 square foot sign setback 25 feet from the right-of-way is more aesthetically in keeping with the area than the 100 square foot sign that would be allowed at the 75 foot setback. Nevertheless, it is staff's opinion that applying the ordinance strictly would not constitute undue hardship in this case. Therefore, staff recommends denial for cause: 1. The applicant has not provided evidence that the strict application of the ordinance would produce undue hardship; 2 . The applicant has not provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity. Should the Board approve this request, staff recommends the following conditions: 1. Sign area shall not exceed 24 square feet. 2 . Sign shall not be located closer than 25 feet to the existing right-of-way of Route 795. 3 . Sign design and colors shall conform to application and example submitted with variance request. 4 . Keeler, Chief of Planning • DATE: March 21, 1991 RE: Board of Zoning Appeals Variance Requests VA-91-11 Simeon Vineyards Limited: In the past, the Planning staff has recommended ordinance amendment (and flexibility in specific cases) intended to be supportive of the agricultural/forestal industry. If this sign is directly related to the vineyard enterprise, County policy would be favorable to variance approval; provided of course, criteria for issuance of a variance are satisfied. VA-91-12 Wm. S. Coleman, Jr. : The Moorman' s River is the only designated County scenic stream and State scenic river, indicating a particular local and state significance as to preservation and protection of the Moorman' s environs . County policy would not be supportive of this variance. This is a 440+ acre parcel and certainly another satisfactory location for a satellite dish can be found without intrusion into the minimum scenic setback. While a property owner should enjoy reasonable use of his property this is not a dwelling restricted by topographical feature or other circumstance, but an entertainment device.
