Box 3751 University Station Charlottesville, Virginia 22903 Statement to the Albemarle County Board of Zoning Appeals June 11, 1991 Item VA-91-12: William S. Coleman's request for a reduction of setback from scenic stream (Moormans River) for a satellite dish, from 65 ft to 58 ft. My name is Jack Marshall. I'm speaking to you as President of Citizens for Albemarle, as a landowner along the Moormans River (I live about a mile down-river from Mr. Coleman) , and as a frequent canoe paddler past Mr. Coleman's property. I'm also a member of the state-appointed Moormans Scenic River Advisory Board, though that Board is currently dormant and I don't presume to speak for other members. Citizens for Albemarle has long had an interest in protecting the natural beauty and purity of the Moormans River corridor. Last year we collaborated with students from Tandem School in their assessment, over a six-month period, of the quality of water in the Moormans. We're now in the second year of a more intensive, higher-tech effort to monitor water quality in the Moormans and several other local streams, a study undertaken jointly with the County Watershed Management Officer. But most relevant to the issue before you now: Citizens for Albemarle is preparing a booklet on the Moormans River corridor - - its geology, social history, plants and animals, and the regulations that protect the river. We began writing the booklet a year ago, with the aim of increasing respect for the scenic river, and of informing riparian landowners what we can and cannot do to maintain its purity and beauty. If we had finished our booklet a year ago, neither Mr. Coleman nor I would be here today. For we accept Mr. Coleman's statement that the placement of the satellite dish within the 65 foot setback - - as well as the construction of his brick fireplace virtually on the edge of the stream -- was inadvertent, an honest error. The fact is, though, that the dish and the fireplace are there (at least the last time I canoed down the river) , and they violate both the letter and the spirit of the scenic stream ordinance. They provide an abrupt, intrusive, and premature end to the natural harmony that characterizes the river corridor for miles up-river and down-river of Mr. Coleman's land. In this regard, we are pleased that the staff report recommends denial of the request to reduce the setback. >�a recycled paper On the other hand, moving the satellite dish seven feet further from the river does not assure us that, though then permissible, it would be less obtrusive. Nor are we convinced that requiring Mr. Coleman to relocate his satellite dish would be the most effective way to ensure that in the future other residents along the Moormans are aware of, and respect, the setback ordinance. Thus, with some ambivalence and a few conditions, Citizens for Albemarle does not oppose Mr. Coleman's request for a seven foot reduction of the setback from the scenic stream. If the Board of Zoning Appeals decides to accept Mr. Coleman's request, we urge that it do so with the following four conditions: First, Mr. Coleman should be required to immediately implement a screening plan using mature indigenous trees and shrubs, so that the satellite dish is completely hidden from the river to the satisfaction of the appropriate county officials. Second, Mr. Coleman should immediately remove from the 65 foot setback any other constructions "other than necessary accessory appurtenant fences and/or walls" -- including the brick fireplace. Third, that in your written decision the Board of Zoning Appeals should indicate unambiguously why this reduction of the setback requirement does not provide a precedent. Those who have struggled to comply with zoning laws, and those from whom we expect compliance in the future, should not cynically interpret your decision as a weakening of the county's resolve to enforce progressive and reasonable environmental ordinances. Finally, we urge the Board of Zoning Appeals to encourage steps that will inform residents along the Moormans River about the existence of the scenic stream ordinance; this would certainly help avoid similar inadvertent violations in the future. One way to do this would be for the Board to recommend that the County provide financial and technical assistance for the production and distribution of the Citizens for Albemarle booklet on the Moormans.
