Approval for a second sign shall be limited to the applicants request of 11. 6 square feet, non-illuminated. Sign color and composition subject to the Zoning Administrator and Architectural Review Board approval. This variance approval allows relief from Section 30. 6. 5. 2 of the Albemarle County Zoning Ordinance to allow a second wall sign to be erected and visible from an Entrance Corridor. REQUEST: The applicant requests relief from Section 30. 6. 5. 1 of the Albemarle County Zoning Ordinance, which states: "30. 6. 5. 1 Regulation of Number, Height, Area, Types of Signs C. Business wall signs shall be limited to twenty (20) feet in height above grade, thirty-five (35) square feet per single sign face, and to one (1) sign per separate highway frontage. " The applicant seeks a variance to allow a second wall sign to be erected and visible from a Entrance Corridor. The sign is 11. 6 square feet in area. Sign material is aluminum, the color will be gold brass finish and the sign will not be illuminated. The sign will consist of individual script letters mounted on the brick wall . The sign will be located on the side of the building facing the entrance road to the Garden Shopping Center. The applicant's justification includes: 1. The sign is standard size and type to direct patrons to the front entrance. 2 . A sign of 11 square feet located on the side of the building will hardly be visible from Route 29 . 3 . The entrance road to the commercial complex should be considered highway frontage, thus allowing an additional wall sign by right. 4 . The square footage for the two (2) requested wall signs in this application is below the allowable limit of 35 square feet for one (1) wall sign in the Entrance Corridor district. 5. The primary wall sign on the front of the building facing Route 29 will be less than 23 square feet in size. Staff Report - VA-91-17 Page 2 RECOMMENDATION: The location, style, composition and colors of the proposed sign would meet the sign regulations being developed by the Zoning staff. However, these regulations have not been reviewed or approved by the Board of Supervisors. The applicant satisfies one of the three criteria of approval: 1. The applicant has provided evidence that the authorization of such variance will not be of substantial detrimnet to adjacent property and that the character of the district will not be changed by the granting of the variance. Nevertheless, it is staff's opinion that applying the ordinance strictly would not constitute undue hardship in this case. Therefore, staff recommends denial for cause: 1. The applicant has not provided evidence that the strict application of the ordinance would produce undue hardship. 2 . The applicant has not provided evidence that such hardship is not shared generally by other properties in the same zoning district and the same vicinity. If the Board should find cause for approval, staff recommends the following: 1. Approval for a second sign shall be limited to the applicants request of 11. 6 square feet, non-illuminated. The Board has established a procedure allowing administrative review and approval of signs which are not in compliance with the requirements of the Entrance Corridor, and wishes to reinforce its desire that there be no alterations or waiver of those standards.
