Re: Justification for the Variance #VA-91-25
Dear Sir:
Herewith I would like to request your approval of the variance from Section 10.4 of the Albemarle
County Zoning Ordinance to allow a corner of the proposed garage to be 71 feet, instead of 75 feet, from
the front road line. Therefore, a variance of 4 feet is desirable for one corner of my proposed garage.
In applying for this variance, I would like to justify the need as follows:
(1) Due to a planning error caused during the construction of my house in 1990, Mr. Harold Davis, who
built the house, failed to leave sufficient space for the future construction of my family room and garage.
Theref re, I will have to use an area in my lot where a mountainous hill with extensive elevation and
sloe; The significant setback of the proposed garage will jeopardize the continuity of overall house and
the appearance of the house will become less attractive to the outside viewers.
(2) The area planned for the garage contain many well-established (some more than 100 years old) trees
and, for obvious environmental advantage, we want to save these unusually beautiful trees.
(3) The extensive soil disturbance associated with the construction of the garage and family room is likely
to cause some erosion problems in the future and it is apparently environmentally not sound.
(4) The excavation cost is extremely high.
The 4-feet variance I am requesting will significantly alleviate all of the above-mentioned
problems. It will help reduce the environmental upset, ecological damage in the long term, and will save
my construction cost. Of course, the overall appearance of my house will also improve greatly with this
variance. For these reasons, I will anxiously await your positive response to this request.
