Dear Zoning Board Members :
It has come to my attention that a need has arisen for a
variance, on lot 22 of Blue Ridge Acres Subdivision , Albermarle
County, in regard to the setback requirements . The setback
requirement is now set at 75 ft . from the property line
(imposed in Sept . 1976) . This ordinance increased considerably
from the 30 ft . setback requirement in place in April of 1963
when the subdivision was establised . As you will notice on
the plat , the lot in question is of limited size , ( . 92 acres) ,
very narrow ,and located on a corner . Due to the layout of the
lot it would be very difficult to position a house in an
attractive way while meeting the setback requirement . To
position the house at a 75 ft . setback would leave the rear
of the house 33 . 82 ft . from the property line and the rear
deck only 23 . 82 ft . from the property line , thus reducing the
privacy space of the backyard to less than lz of the space in
the frontyard .
With the proposed setback of 60 ft . from the property line.
we will be able to position the house in an attractive manor
while giving a decent cushion from the back property line
(48 . 6 ft . from house/38 . 6 ft . from deck) .
Also you will notice there is a foundation and footing
already located beyond the 60 ft . setback requested for
which the owner already has spent in excess of $600 . , in
good faith , with the previous contractor who failed to notice
the 75 ft . setback requirement .

In conclusion, of all the houses in the - subdivision only
two have a 75 ft . setback, while many others are well below
the 60 ft . setback we are trying to achieve .
As being newly placed in charge of this project by the
owner , Howard M. Carr , I feel that by allowing Mr. Carr the
60 ft . setback you will enable him to place this house in
the most attractive way for him without any unnecessary con-
struction costs , or affecting the immediate community in any
negative way .
