Dear Mr. Holdren,
This acknowledges receipt of yours of January 21, 1992 . The Board
of Zoning Appeals by-laws have a provision to request a rehearing
in the event of new or corrected information, and the like. (See
the attached excerpt from the by-laws. ) This may or may not
qualify.
You may appear at the next regular meeting, on February 11th, to
request a rehearing. At that time, the Board of Zoning Appeals may
determine whether or not to again hear the case, and at which date.
You or your representative should be present to state your
justification. The rehearing itself, shall comply with all the
State Code requirements for notice, and cannot occur until a later
date.
Be advised, you have a right to appeal to court (State Code Section
15. 1-497) . This petition for writ of certiorari shall be filed
within thirty (30) days after the Board of Zoning Appeals decision.
A copy of your letter and mine will be forwarded to the Board of
Zoning Appeals, if you request a rehearing. Please inform this
office by January 30th, if you wish to be scheduled to speak to the
Board on February llth.
