Please let me explain. The motion was made by Mr. Bailey "to allow the top of my sign to be turned and to disallow the bottom portion completely, and to follow the other 3 recommendations of staff". Mr. Bailey's discussion prior to the motion, was that the bottom portion COULD NOT be read by the people in the cars on the highway. Not knowing for sure who could and who could not read it, I failed to answer. Neither did the Zoning Staff - and this is my point. That same evening during a public hearing the Zoning Staff showed a chart from the D.O.T. I think, that showed "A 10" Letter" (that's our size) can be read by the motoring public at 45 mph. -__ - U' My point is that the Zoning Staff is a public employee - you look to them for guidance, I look to them for fairness. I think if they knew that information they should have told Mr. Bailey right then. They did not tell him, and I think it was because it would have gone against their efforts, and would have supported mine. . . .That is unfair and they were keeping from you knowledge that could have helped you make a more fair judgement. (The BZA) . If I have to remove my reader board it will mean, on my left I have the 500 sq ft'7LAMO Sign, and on my right a 140 sq ft Car Dealer Sign - mine will be 48 sq ft only; talk about a hardship and getting lost in the forray - now you have created a greater hardship instead of helping alleviate a hardship, and i It's 10,' off the ground the" trees will totally block it from the Sixth Bound Traffic- ; 4:„./ t inledCia agbutetga4 If the "other 3 points of the staff report" is part of the motion then here's what happens (attached) . 1 Menu Board removed - already noted. 2 Height shall be no more than 10 ft. Now I have a 48 sq ft sign 30 ft set back to the pole. And Only 10 ft off the gourd I don't need that kind of help and I think the board didn't realize, with the uncertainty of the motion that "The other 3 points of staff relations" was creating this fiasco. I respectfully request a new hearing fLOUt The Board of Zoning Appeals, based on a "mis-trail" or mis information given and that the hearing of January 14th, 1992 be stricken from the records.
