This project is denied for reasons listed below. The application may be resubmitted for approval if all of the items below are satisfactorily addressed. The VSMP application content requirements can be found in County Code section 17-401. A. Stormwater Pollution Prevention Plan (SWPPP) The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain (1) a PPP, (2) an ESOP, (3) a SWMP, and (4) any TMDL measures necessary. 1. Revise Sec. 4, ESC Plan. 2. Revise Exhibit, Sec. 6 B. Pollution Prevention Plan (PPP) The PPP content requirements can be found in County Code section 17-404. 1. See A /Sec. 6 comments, above. C. Stormwater Management Plan (SWMP) — Provide SWM Plan for additional 1.80 Ac. land disturbance VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP. This plan is disapproved for reasons listed, below. The stormwater management plan content requirements can be found in County Code section 17-403. 1. Submit VaRRM.xls Redevelopment Compliance spreadsheet —sample attached. Sample indicates phosphorus load reduction is required if forest transitions to turf. Note, however, that since forest is located on preserved step slopes, a SWM Plan is, for the moment, insufficient for Amendment plan approval. D. Erosion and Sediment Control Plan (ESCP) Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan is disapproved for reasons listed, below. The erosion control plan content requirements can be found in County Code section 17-402. Engineering Review Comments Page 2 of 5 Show /label preserved steep slopes. Ref. Revise plan to eliminate proposed impacts to preserved steep slopes. Immediately cease any ongoing unauthorized impact to preserved steep slopes. CDD became aware of possible impacts to preserved steep slopes on parcel ID 07800-00-00-00600 via county inspection, not Applicant submittal of plan amendment application. There may be ongoing work (transfer of material from site reviewed under WPO2018-00088 (left side, image above) to Malloy Ford parcel) that, until this point, has not been reviewed or approved by Albemarle County. Applicant is requested to: a. Provide status of off -site stockpile operations (haul roads, transfer of material, clearing). b. Affirmatively state whether impacts to preserved steep slopes have occurred. c. Delineate impacts, if any, to preserved steep slopes. (Also, 6.c., below) d. If unauthorized impacts have occurred, Applicant is requested to propose remedy, to include: i. Immediate cessation of further impact to preserved steep slopes ii. Removal of stockpile material placed on preserved steep slopes iii. Stabilization iv. Reforestation v. Timeline and estimated completion dates for: 1. Material removal, 2. Stabilization, 3. Reforestation. Trees should be planted fall, 2019, and survival monitored. Albemarle emphasizes land disturbance activity is subject to a range of local or state requirements, is subject to review and approval, and limits. County Code Ch. 18-30.7.4.b.I (by right use on preserved steep slopes) does not appear to allow any disturbance to preserved steep slopes at Malloy Ford (TMP ID 07800-00-00-00600). By right uses include: a. Existing single-family dwelling unit b. Existing lot of record, first single-family detached dwelling unit c. Necessary public facilities d. Trails e. Accessory uses and structures f. Distribution facilities g. Legislative Zoning Actions related to the underlying district h. Slopes less than 25% based on new geographic information 3. Albemarle County Code 18-30.7.4.b.2., By special use permit, does not authorize impacts to preserved steep slopes at TMP 07800-00-00-00600. Preserved steep slopes on TMP 07800-00-00-00600 appear ineligible to be cleared, graded, etc. No impacts to these preserved steep slopes appear permissible. If Applicant position is otherwise, notify Engineering immediately. 4. Albemarle is unaware of Legislative Zoning Action that would have authorized stockpile operations or any other impacts to preserved steep slope on TMP # 07800-00-00-00600. At this point, no authorization to disturb preserved steep slopes on this parcel is known to exist. If project -related impacts at this time cause any impact to preserved steep slopes on this parcel, by this and additional notification to follow, Applicant is to cease activity that impacts preserved steep slopes. Please contact Engineering if any questions. 5. Revise plan to avoid preserved steep slopes. 6. Provide estimate of Area (ft2) of stockpile proposed on Malloy Ford parcel (07800-00-00-00600): a. Ex. gravel or paved surface (Stockpile 1, a), b. Preserved steep slopes (Stockpile 2 —b, c, d), c. Preserved steep slopes impacts that may have occurred (grading /material transfer, haul road, etc.), d. Areas other than areas listed at a., b., c. 7. Renumber notes: there are two Note 2.s on each sheet. 8. Sheet Al of 2 ESCP Amendment Narrative, second Note 2 includes statement that stockpile must achieve permanent stabilization. Please clarify whether Stockpile 1 is proposed permanent stockpile placed on pavement. If not, please revise second Note 2 to reflect design intent. 9. Sheet A2 of 2 ESCP Amendment Narrative, Note 3 is inaccurate. Satellite image, above, shows area proposed for Stockpile 2 is forested. If forest is cleared for a temporary or permanent stockpile, runoff to the stream is not reduced. Revise note. Engineering Review Comments Page 4 of 5 10. ESC Amendment Narrative assumes inaccurately that no runoff analysis or management is required. Total area of proposed land disturbance is estimated to `Add about 78,500 SF to the limits of disturbance, bringing the total to 9.05 Ac. for the project.' Stockpiles 1 and 2 are not independent of one another, or of WPO201800088. Were cursory analysis performed using VaRRM.xls redevelopment worksheet, a phosphorus reduction requirement displays, since forest transitions to turf. Please see Sec. C., Stormwater Management Plan, above. Review /revise ESCP Amendment Narrative consistent with state and local VSMP requirements. For re -submittals please provide 2 copies of the complete permit package with a completed application form. Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to discuss this review. Process: After approval, VPDES Permit VAR10E170 will be modified. ESC plan proposing additional ESC measures will need to be bonded. The bonding process is begun by submitting a bond estimate request form and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and check parcel (07800- 00-00-00600; Malloy VII-Richmond Road LLC) and easement information based on the approved plans. The County's Management Analyst will prepare bond agreement forms, which will need to be completed by the owner (Re£ county real estate records) and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to obtain all the correct signatures and forms. Engineering Review Comments Page 5 of 5 After bonding is complete, Albemarle County can hold a pre -construction conference. Applicants will need to complete the request for a pre -construction conference form, and pay the remainder of the application fee. The form identifies the contractor and responsible land disturber, and the fee remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction conference will be scheduled with the County inspector. At the pre -construction conference, should everything proceed satisfactorily, a grading permit will be issued by the County so that work may begin.
