Box 192 Keswick, VA 22947 RE: Board of Zoning Appeals Action Tax Map 78, Parcel 17D2 Dear Mr. Wilson: This letter is to inform you that on May 12, 1992, during the meeting of the Albemarle County Board of Zoning Appeals, the Board unanimously approved your request for VA-92-13, subject to the following condition: 1. If after November 30, 1993 the use is not allowed to continue at the site, the sign shall be removed. This variance approval allows relief from Section 21.7. 1 of the Albemarle County Zoning Ordinance to reduce the front setback from Riverbend Drive from 30 feet to 8 feet for a freestanding sign. Si erely, John Grady Deputy Zoning Administrator JG/sp`- cc: Riverbend Drive Land Trust STAFF PERSON: John Grady PUBLIC HEARING: May 12, 1992 STAFF REPORT - VA-92-13 OWNER: Riverbend Drive Land Trust APPLICANT: Mark Wilson TAX MAP/PARCEL: 78/17D2 ZONING: Planned Development Shopping Center ACREAGE: .475 acres LOCATION: On the west side of Riverbend Drive approximately .2 mile south of Route 250 between First Virginia Bank and Burger King. REQUEST: The applicant requests relief from Section 21.7. 1 of the Albemarle County Zoning Ordinance, which requires a 30 foot sign setback. The applicant proposes that a freestanding sign remain as located eight (8) feet from the right-of-way of Riverbend Drive. The sign is constructed of wood, six (6) ,square feet of sign area, six (6) feet in height. The sign copy is green and black on a white background. The sign is used to identify the pre-constructed storage buildings that are sold on the site. The sign meets the requirements of the Entrance Corridor regulations with regard to sign area, height, color and style. The Architectural Review Board has reviewed and approved the sign and will issue a Certificate of Appropriateness should this variance be granted. This request involves a variance of the Commercial Districts, Generally as follows: Commercial Districts generally (Section 21.7. 1) Freestanding Sign: To reduce the setback adjacent to public streets for freestanding signs from 30 to 8 feet along Riverbend Drive, a variance of 22 feet. The applicant's justification includes: 1. The sign is positioned to best serve the aesthetic appeal and commercial nature of the site. 2 . If the sign is located at a 30 foot setback, it will be obstructed from view by the trees, and the storage buildings would have to be relocated. 3 . The sign is temporary and the request is for 18 months to coincide with the use of the lot which was approved by the Architectural Review Board. Staff Report - VA-92-13 Page 2 RECOMMENDATION: Staff concurs with the applicant that if the sign is relocated to a 30 foot setback, the landscaping trees along Riverbend Drive will obstruct the view of the sign. Staff also feels that it can support this request as the applicant's sign does meet all the criteria that is being recommended to the Board of Supervisors in the proposed sign ordinance. Therefore, staff recommends approval of the variance request. Should the Board find cause for approval, staff recommends the following: 1. If after November 30, 1993 the use is not allowed to continue at the site, the sign shall be removed.
