Dear Mr. Abell:
This letter is to inform you that on May 12, 1992 , during the
meeting of the Albemarle County Board of Zoning Appeals, the Board
unanimously approved your request for VA-92-16, subject to the
following conditions:
1) Approval shall be for building permit #92-456 NNC only,
and
2) Dugouts be painted the color approved by the Zoning
Administrator.
This variance approval allows relief from Section 10.4 of the
Albemarle County Zoning Ordinance to reduce the front setback from
Park Road from 25 feet to 13 feet and to reduce the side setback
from 25 feet to 14 feet for a little league baseball dugout.

LOCATION: On the north side of Park Road approximately .4
mile east of High Street.
REQUEST:
The applicant requests relief from Section 10. 4 of the Albemarle
County Zoning Ordinance, which states:
"10.4 AREA AND BULK REGULATIONS
yards minimum: side 25 feet, front 25 feet"
The applicant requests a twelve (12) foot variance from Park Road
and an eleven (11) foot variance from a side property line for two
(2) dugouts to remain as built. The dugouts were constructed with
cinderblock walls, a wood and asphalt shingle roof. The dugout
will be thirteen (13) feet from Park Road and fourteen (14) feet
from the side property line.
The applicant's justification includes the following:
1) The dugouts were built to protect the players from the weather
and foul balls.
2) The dugouts help keep the team together.
3) The volunteer group that relocated the field and built the
dugouts were unaware that a building permit or a building
setback would be required.
4) The new location of the field helps to protect the players'
eyes from the afternoon sun.
5) The new location was chosen for its economic and environmental
benefit. There was only minimal grading for the infield to be
constructed; no trees had to be cut and no fill was required.
6) The new field location also allows for a permanent pitcher's
mound to be constructed.
7) It was never the intention of the Peachtree Little League or
Park Association to violate County regulations.

RELEVANT HISTORY:
Staff recognizes that each variance is reviewed on it own merits,
and is not on its face, precedent-setting. The following history
is provided for information:
The reason the baseball field was relocated was to allow the park
better use of the land adjacent to the entrance road into the
park. Previously the area adjacent to the entrance road was
shared by Peachtree, the Arts and Crafts Festival, the Fourth of
July Festival, and other events sponsored by the Park. The
Peachtree Little League Association along with a group of
volunteers, using materials donated by local merchants, agreed to
relocate the little leaguer field. T i-s- s to -allow-for°better—=

RECOMMENDATION:
It is staff's opinion that moving the field 300 to 400 feet
further down the property adjacent to Park Road should not be of
substantial detriment, nor change the character of the district.
It is also apparent because of the limited space and rolling
topography that this hardship is not shared by other park
properties in this vicinity, such as Mint Springs. Staff is
sympathetic and believes the volunteer groups were working in good
faith for a good cause. However, the applicant does not meet the
remaining criteria listed below, therefore staff must recommend
denial for cause.
1) The applicant has not provided evidence that a strict
application of the ordinance would produce an undue hardship;
Should the Board find cause to approve this request, staff
recommends the following conditions:
1) Approval shall be for building permit 92-456 NNC only.
