The canopy will enable us to provide _a_safe. well lit area for customers as well as protection from inclement weather. JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA: 1) That the strict application of this ordinance would produce undue hardship. • The strict application of the 150' setback in the H.C. zone would pro- hibit us from developing the site as our property is 200 feet deep with the rear 80 feet being very steep and wooded. The existing service station uses the front 100 feet of the site. 111 2) That such hardship is not shared generally by other properties in the same zoning district and the same vicinity. All the properties located in a close proximity to our station, including our station, are not set back 150 feet. �►, � 3) That the authorization of such variance will not be of substantial detriment to adjacent property and that the �51 character of the district will not be changed by the granting sC) O of the variance. A 3f'setback is consistent with the adjacent properties as well as with the developrient up and done the route 250 corridor, and would not be detrimental to any adjacent property. The new country store and gasoline canopy should enhance adjacent property and will provide a nicer facility for customers to fuel their vehicles and make their convenience purchases.
