This project is denied for reasons listed below. The application may be resubmitted for approval if all of the items below are satisfactorily addressed. The VSMP application content requirements can be found in County Code section 17-401. A. Stormwater Pollution Prevention Plan (SWPPP) The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain (1) a PPP, (2) an ESOP, (3) a SWMP, and (4) any TMDL measures necessary. 1. Revise Sec. 4, ESC Plan. 2. Revise Exhibit, Sec. 6 B. Pollution Prevention Plan (PPP) The PPP content requirements can be found in County Code section 17-404. 1. See A /Sec. 6 comments, above. C. Stormwater Management Plan (SWMP) — NA /VaRRM.xls not required for stockpile on impervious area. Note: 18-5.1.28.b.5. requires placement of fill or waste shall be completed within one (1) year of its commencement. D. Erosion and Sediment Control Plan (ESCP) Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan is disapproved for reasons listed, below. The erosion control plan content requirements can be found in County Code section 17-402. 1. Include on plans text from Code 18-5.1.28.a.I., a.3., verbatim. 2. Include on plans text from Code 18-5.1.28.a.4., modifying as needed to account for proposed impervious base of stockpile. That is, reclamation of stockpile areas (1 and 2) does not require covering the area with clean fill to a minimum depth of two (2) feet in order to allow for permanent stabilization, unless Ex. pavement or gravel is removed with stockpile material (at end of one (1) year, or lesser period if stockpiles are removed earlier). If Ex. pavement /gravel are removed with stockpile Engineering Review Comments Page 2 of 3 material, then the area should be covered with clean fill to a minimum depth of two (2) feet in order to allow for permanent stabilization. Plan sheet Notes (Al, A2) should reflect 18-5.1.28.a.4. intent. Include on plans text from Code 18-5.1.28.b. L-5., verbatim. Note: Add the following to 18-5.1.28b. I.: `Requirement to clean transport vehicles does not apply to vehicles that do not enter a public or private road, but use internal intra-parcel (temporary) haul roads, only.' Show and label preserved and managed steep slopes. 5. Note: Code Ch. 18-30.7.4.b.I (by right use on preserved steep slopes) does not allow any disturbance to preserved steep slopes at Malloy Ford (TMP ID 07800-00-00-00600). By right uses include: a. Existing single-family dwelling unit b. Existing lot of record, first single-family detached dwelling unit c. Necessary public facilities d. Trails e. Accessory uses and structures f. Distribution facilities g. Legislative Zoning Actions related to the underlying district h. Slopes less than 25% based on new geographic information 6. Note: Albemarle Code 18-30.7.4.b.2., By special use permit, does not authorize impacts to preserved steep slopes north of stockpile 1, or west of stockpile 2. Preserved steep slopes on TMP 07800-00-00- 00600 are ineligible to be cleared, graded, etc. No impacts to preserved steep slopes are permissible. 7. Include Note that prohibits land disturbance on preserved steep slopes. 8. Provide estimate of Area (ft2) of stockpiles proposed on Malloy Ford parcels (07800-00-00-00600, stockpile 1; 07800-00-00-00700, stockpile 2). 9. Renumber Notes: there are two Note 2.s on each sheet. Engineering Review Comments Page 3 of 3 The VSMP permit application and all plans may be resubmitted for approval when all comments have been satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package with a completed application form. Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to discuss this review. Process: After approval, VPDES Permit VAR10E170 will be modified. ESC plan proposing additional ESC measures will need to be bonded. The bonding process is begun by submitting a bond estimate request form and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and check parcel (07800- 00-00-00600; Malloy VII-Richmond Road LLC) and easement information based on the approved plans. The County's Management Analyst will prepare bond agreement forms, which will need to be completed by the owner (Ref. county real estate records) and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to obtain all the correct signatures and forms. After bonding is complete, Albemarle County can hold a pre -construction conference. Applicants will need to complete the request for a pre -construction conference form, and pay the remainder of the application fee. The form identifies the contractor and responsible land disturber, and the fee remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction conference will be scheduled with the County inspector. At the pre -construction conference, should everything proceed satisfactorily, a grading permit will be issued by the County so that work may begin.
