Patterson, Zoning Administrator Virginia 22901 County of Albemarle (804)973-5536 401 McIntire Road Charlottesville, VA 22901-4596 RE: Request for height variance Dear Ms. Patterson: I am writing in response to STAFF REPORT - VA9221 which I received on July 2, 1992. We were disappointed that the County Administrative Offices have yet again demonstrated an adversarial position to the Board of Supervisors intent that Covenant Church be allowed to construct a sanctuary for 800 people on Route 643. It has now been two years of advance and retreat with the County. The bureaucratic structure seems too complicated, and not at all designed for efficiency of the taxpayer. We do have several questions regarding the above stated application. If they could be answered, it would help us to be much better prepared for the meeting scheduled on July 14. Questions: 1. Is it the general policy of the Zoning Department to recommend denial for a request for variance? Yes No 2. Your report indicates a rejection of the "hardship" issue. Yet, the recommendation for denial of "hardship" does not specify any concrete evidence for rejecting the request. Is such evidence available? Yes No Can we be made privy to such evidence prior to the appeal meeting? SENIOR PASTOR Yes No Harold L. Bare, Sr. PASTOR Youth and Music Jerry Steele PASTOR Education and Extension Victor Morris 3. The issue of "hardship is not shared generally by other properties in the same zoning district and the same vicinity", seems rather moot. This is unique to the area, an approval granted by the Board of Supervisors, and to our knowledge no other development of a church is in process in the area. How then can a direct comparison be made? Please provide us with information helpful in presenting to the Zoning Board. 4. Regarding detriment to adjacent property, the question is not will a church de-value adjacent properties. The question is will an additional ten feet (10') of height damage adjacent properties. The County Code provides for advertisement and public notice to adjacent property owners. This has been done. Are there recorded protests from adjacent property owners? Yes No If yes, are we allowed to know about such protests prior to the Zoning Meeting? Yes No If no protests of property owners have been filed, how does the County decide, by what professional formula, e.g., commercial appraisers, historical records, etc., that a building with the height proposed will depreciate the value of adjacent properties? Or, is the recommendation for denial a subjective evaluation? Yes No Or, is it a democratic vote of the component staff people dealing with the total request? Yes No 5. Reference is made to Mr. Carver, who served as an architect in Virginia Beach, a different municipality with peculiarities of military bases, sandy soils, and level terrain hardly to be compared to the proposed Covenant Church site on Route 643 in Albemarle County. Does this indicate that applicants in Albemarle County are to take into consideration the geographic, climatic, and soil conditions of other municipalities? Yes No 6. The report indicates evaluation in terms of total usage of land. Is this an inherent recommendation from Zoning as to the shape and size of the proposed building? Yes No Or, is this a suggestion that a number of buildings should be constructed? Yes No Or, is it a suggestion that our architect and engineer should receive pre-design recommendations from County officials? Yes No 7. The recommendation that "height of the building shall not exceed 46 feet at any facade" seems clearly in violation of Code, Definitions, Page 9, which state that "mean height level" is to be determined by ground to mid-point of the gable. You have already ruled that the East side is the front. To recommend a maximum facade height of 46' seems in contradiction both to Code and to your previous ruling. Again, is there any scientific evidence to justify the recommendation for altering the Code to 46' of facade? Yes No If yes, please offer such evidence, i.e. statutes and codes. 8. By County Code the property in reference is not included in the Architectural Review area. Attempts to bring it into the Architectural Review area appear to be yet another form of control to frustrate the church carrying out an effective plan for construction. Is there justification for the church being subjected to the Architectural Review Board, when we have already paid thousands of dollars for an Engineer and Planning Site Permits for the cause of insuring appropriateness with the area? Yes No Has this request, and possible contingency, been referenced with the interpretation of the Board of Supervisors and Planning Commission decisions to approve the construction of a church? Yes No It would appear to us that the Board of Supervisors approval was tantamount to indicate a church of 800 would be an unusually large building for the zone and district in question. Is county policy such as to complicate the will of the Board of Supervisors? Yes No We are naturally frustrated. Tens of thousands of dollars and two years later we simply are not getting any indication of cooperation from the County Administrative Offices to proceed with construction. Each department works separately, with overlap, and with contingencies predicating other contingencies, thus delaying our ability to meaningfully use the land. For every process there is a fee. Frankly, we do not feel cooperation from the County. Smiles and politeness only camouflage an administrative nightmare that is financially and time-wise unending. Candidly, we lack knowledge of codes and statutes which justify the recommendation for denial of request VA-9221. Supplying us with the above requested information will be immensely helpful to our understanding of the process, and it will greatly assist us in preparing for our meeting with the Zoning Board. You will note that copies of this letter and the staff report are being sent to the persons listed below. This is an effort on our part to inform appropriate officials, and hopefully bring about a process that will be more expeditious for the church and consistent with our Special Use Permit.
