The original survey showed the house was 53 feet from the side property line. The garage was closer, but as it was originally detached the survey showed that the residence did not violate any side yard setback requirements. I have enclosed a copy of this survey marked as Exhibit A. After the closing, we discovered the problem and had the survey changed to reflect the fact that the garage was no longer detached as the prior owners had completed an addition to the residence. The new revised survey is enclosed as Exhibit B and shows the garage located 18 feet from the property line. Apparently, Mr. and Mr. Deluce purchased the house in April, 1987. Subsequently, in October, 1988 , they applied for a building permit (#88-1487AR) to complete a master bedroom and study addition to the house which resulted in the detached garage becoming attached to the main residence. According to the Inspections Department, the contractor in submitting his plans submitted a sketch showing the garage approximately 30 feet from the side yard boundary line. This was an error as, I am informed, the contractor only estimated the distance and did not have a survey completed. Then to compound the problem, the contractor never applied for a final inspection. Once we discovered this, we ordered a final inspection for the addition which was approved on May 20, 1992 . This is enclosed as Exhibit C. Assuming my clients obtain this variance, then the final certificate of occupancy can be completed for their residence. It is my clients' desire that a variance for the garage be granted in order that they can legally live in the addition and that the property will be marketable in the future should they ever desire to sell it. JUSTIFICATION 1) That the strict application of this ordinance would produce undue hardship. Mr. and Mrs. Mares are the new owners of this property. They were not the original owners who built the house and detached garage. Also they were not the former owners who built the addition which attached the garage to the house and thereby created the violation. As I understand the ordinance, the detached garage did not violate the side-yard setback. It was only after the addition was completed that the house with the attached garage violated the setback. Finally, had either the contractor or the County Inspections Department performed an actual survey, then the potential violation would have been discovered prior to the former owners building the addition.
