A site plan has preliminary site plan approval. The site has been clear-cut and extensive grading has taken place. It has been designated as a burrow source for the county road project to connect Berkmar Drive north of Rio Road to access the new Agnor-Hurt elementary school. About 15, 000 cu. yds . of dirt has been removed and an additional 50, 000 to 60, 000 cu. yds . will be removed in the future. The property, i.e. , 8 .7 acres , has a topo fall off of 48 ' from the S/W corner to the N/E corner of the property. Because the fall off is from the rear of the property to the front corner of Rio Road and Berkmar Drive, utilization of the rear is presenting a significant hardship. The ordinance provides for a 50 ' buffer between the edge of any building to a P/L against a residentially zoned property. The ordinance further allows parking in that buffer zone to within 20' of residentially zoned property. Because of the topo hardship discussed earlier we are not able to use this 50 ' buffer for any parking. We request that the 50 ' buffer be reduced to a 25' buffer along the line shaded in orange on the site plan.
