Zoning Administrator AGM/sp cc: Linwood Lewis Allen Enclosure STAFF PERSON: Amelia McCulley PUBLIC HEARING: February 9, 1993 STAFF REPORT - 92-43 OWNER / APPLICANT: Linwood Lewis Allen (owner) Albemarle Housing Improvement Program (applicant) TAX MAP / PARCEL: 126 / 31A6 ZONING: RA, Rural Areas ACREAGE: 2 . 0 Acres LOCATION: In Schuyler at the Nelson County line, on the south side of Route 800. HISTORY: This property was originally part of approximately 650 acres of quarry land. The rear portion of the site is an abandoned quarry. This is one of 8 houses which were built over 60 years ago for the employees of the stone company. Until recently, they were rental units, and have remained within the family. By Special Permit 90-11 and the subsequent subdivision plat, the Board of Supervisors approved the creation of an individual lot for each house. In addition, on March 13, 1990 the Board of Zoning Appeals approved the variances for this subdivision (VA 90-12) . This has allowed for homeownership for those who had rented for generations. Currently the houses have no indoor plumbing and water is available from outside frost-free faucets installed by the Nelson County Service Authority. The current practice is for water to be thrown out the back door. All houses have outdoor toilets. Of the eight homes, only four have soils suitable for any conventional septic disposal field. Of the four, two (lots #5 and 8) are able to provide a 100% drainfield. A.H.I.P. is currently working with the State Health Department and the County, to provide some alternate sewage treatment / disposal for the other 4 homes on lots 1-4 . REQUEST: The owner, with the assistance of the Albemarle Housing Improvement Program (A.H. I.P. ) would like to rehabilitate an existing house, including the installation of indoor plumbing. A variance is necessary because a 100% reserve septic field area is not available. Staff Report - VA-92-43 Page 2 The existing house is 2 bedrooms. No additional bedrooms are proposed. A 50% reserve septic area would be available in front of the proposed drainfield. This involves a variance of Section 4. 1. 6, which requires that prior to issuance of any building permit, approval shall be received from the Health Department for both original and future replacement septic fields of adequate area to accommodate a three (3) bedroom dwelling. Based on the required sizing standard for a three (3) bedroom dwelling, only a 25-30% reserve area is available. (Note: The Zoning Ordinance does not require that the septic field be built larger, so as to handle a 3 bedroom house. ) The bathroom will be added within the existing walls of the house, or if necessary will be a 5 x 8 foot addition. In addition to the plumbing work, there will be substantial rehabilitation. This will include structural work to repair termite damage, electrical upgrade, insulation, windows, doors, and the like. The applicant's justification includes: 1. Without approval of this variance, A.H.I.P. will not be able to make any improvements at all. The grant money is regulated by HUD Minimum Property Standards and Section 8 Housing Quality Standards, and both require that they meet Minimum Property Standards. No indoor plumbing is a failing quality. Without these improvements, these residents will continue to live under substandard conditions. 2. Without these improvements, the property will fall into further disrepair. 3 . Without these improvements, the property values in the area will be negatively impacted. THIS REPORT IS TERMINATED BECAUSE AFTER FURTHER RESEARCH INTO THE PROPERTY HISTORY, I HAVE FOUND THAT THIS VARIANCE HAS PREVIOUSLY BEEN AUTHORIZED BY VA 90-12 . WITH THAT VARIANCE FOR THE SUBDIVISION, THE BOARD ALLOWED SIX (6) LOTS WITHOUT PRIMARY OR RESERVE SEPTIC FIELDS.
