Variance to increase the height of a wall sign from 20 to 27 ft. \qlr\ DESCRIPTION OF REQUEST: The Kroger Co. would like to request a variance from the required twenty (20) feet maximznn height from top of Kroger sign to grade. The Kroger Co. proposes mounting the signage approximately twenty-seven (27) feet from the top of the Kroger sign to grade. JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA: 1) That the strict application of this ordinance would produce undue hardship. ATTACHED. ) 2) That such hardship is not shared generally by other properties in the same zoning district and the same vicinity. Presently the existing Ames sign is approximately twenty-four (24) feet from top of Ames sign to grade. 3) That the authorization of such variance will not be of substantial detriment to adjacent property and that the character of the district will not be changed by the granting of the variance. Kroger believes the presence of this store and its sign will only benefit adjacent property owners by increasing customer traffic to the Rio Hill Shopping Center. Since Kroger will inhabit the existing Ames store, no change in character of the district is anticipated. The application may be deferred by the staff or the Board of Zoning Appeals, if sufficient information necessary to this review has not be submitted by the deadline. JUSTIFICATION ATTACHMENT Kroger at Rio Hill Center, Charlottesville, VA 1. That the strict application of this ordinance would produce undue hardship. The existing building' s entrance soffit is presently 10 ' -6" above the sidewalk. This height matches the existing architectural split-faced ribbed concrete masonry accent band at the front elevation. Kroger intends to maintain this existing relationship between soffit and accent band. In order to meet the twenty (20) feet maximum height requirement, Kroger would need to provide an atypical size Kroger sign. In addition, this would require mounting the sign within the accent band and locate the sign just above the entrance soffit height. It is Kroger' s opinion this would detract from the Kroger entrance as well as the aesthetics of the shopping center. I have enclosed three elevations. Scheme one indicates the preferred elevation. Scheme two indicates the elevation required to meet the twenty (20) feet maximum height from top of Kroger sign to grade. I have also included the existing elevation. 4:1 VARIANCE CHECKLIST The current application form must be completed by the applicant in its entirety (the request should be clear) . THE FOLLOWING INFORMATION SHALL BE SUBMITTED WITH THE APPLICATION AND IS TO BE PROVIDED BY THE APPLICANT. (x ) Application with justification statement. (X ) Most recently approved recorded plat. If none exists, then a copy of the deed description for the property or properties involved in the request. (X ) The appropriate drawings showing all existing and proposed improvements on the property, with dimensions and distances to property lines, and any special conditions of the property that may justify the request. SCHEDULE A The Demised Premises shall consist of a portion of a one-story building ("the Building") , containing seventy-eight thousand eight hun- dred twenty-three (78 , 823 ) square feet of floor area, having a frontage of three hundred twelve ( 312 ) feet and other dimensions as shown upon the plan attached hereto ( "the Lease Plan" ) , plus two equipment platforms therein containing an aggregate of eight thousand six hundred eighty-five ( 8 , 685 ) square feet of floor area and are the premises within the shopping center referred to hereinbelow labelled AREA "A" on the Lease Plan. In addition, Tenant shall have the exclusive right to use certain service areas shown upon the Lease Plan adjacent to the Demised Premises which contain an exterior loading dock and compactor pad. It is expressly understood and agreed that said service areas shall not be included in computing Tenant ' s Fraction (defined in Section 6 . 1 ) for purposes of Article VI and Paragraph 9 of Schedule B. The Demised Premises are situated within the so-called Rio Hill . Shonning Center on the westerly side of U. S . Route 29 (herein, together with each of the streets labelled PROPOSED ROADWAY upon the Lease Plan (the "New Streets" ) , collectively referred to as "the Main Streets" ) in Charlottesville , Virginia.
