1) That the strict application of this ordinance would produce
undue hardship.

in the same zoning district and the same vicinity.
3) That the authorization of such variance will not be of
substantial detriment to adjacent property and that the
character of the district will not be changed by the granting
of the variance.

Description of Request:
Applicant requests variance of the side yard setback requirement so that
two existing structures, a house and cottage, can be joined to form one
single family residence.
1. Without variance of the setback requirement the existing structure placed
at the lot line remains unusable as an integral part of the applicant's
residence.
2. The surrounding community was built well before the current zoning laws
were established; it is reasonable to assume that there are other
properties that do not conform to setback requirements.
3. The proposed garage addition, though attached to both cottage and house,
conforms to the 6 foot side yard setback for detached garages. There is
considerable space between the lot line and adjacent residences, and the
existing house is well within setback requirements on the other three
sides. The addition is small compared to the existing structures and will
be compatible in appearance and scale. It will be screened from general
view by existing trees which will not be disturbed.

RE: Joan M. Ferrill Request
Dear Mr. Grady,
We are in receipt of your June 18, 1993 letter to us and our
neighbors concerning the Ferrill's request for a variance to reduce
the side yard. We reviewed the plan submitted to you by Jack
Rinehart, A.I .A. and can support their request.
Their existing cottage built in the 20's is one foot from the
property line and the Meade bath house, adjacent to the Ferrills
on the east, is also built near the property line. The new addition
should work well for the Ferrills by tying their two structures
together and giving them a much needed garage.
I briefly reviewed the variance request with Mr. Meade, Mrs.
Wells, and Mr. and Mrs. Lindsay and they all support the variance
request and voiced no objections.
With Jack Rinehart providing the architectural services and
knowing that the Ferrills are only interested in doing a specials
remodel , the finished product should turn out well. It would be BLUE RIDGE
helpful if the neighbors could review the final building elevation
since it was not submitted as part of the request. LANE
I will be out of town on July 13 so will be unable to attend CHARLOTTESVILLE
the hearing. VIRGINIA
