the Moorman's River in Sugar Hollow, about 1/2 mi from Rt 674 ,
TM25/P17 , zoned Rural Areas. Variance to reduce the reserve
septic area from full 100% to 0%, for subd of an existing house
into a 3 ac lot. \qlr\
DESCRIPTION OF REQUEST: We are requesting a variance to the re-
quirement that a new parcel have a location for a 100% backup septic
drainfield. We are in the process of purchasing the house where we
have lived for thirteen years . The house is one of the oldest in
Sugar Hollow, and we believe it was built in the late nineteenth
century. Technically, it would be a "new" parcel because the owner
will be selling us approximately three acres ( CONTINUED ON ATTACHED)
JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce
undue hardship.
The strict application of this ordinance would cause undue hardship
because we could not complete the purchase of our home. We have
rented the house and lived in it for the last 13 years . We have
discussed buying it from our landlord for at least the last five
years . Since we began the process of actually ( CONTINUED ON ATTACHED)
2) That such hardship is not shared generally by other properties
in the same zoning district and the same vicinity.
The conditions of being surrounded by streams and a steep grade are
specific to this house, and are not shared by the neighborhood
generally.
3) That the authorization of such variance will not be of
substantial detriment to adjacent property and that the
character of the district will not be changed by the granting
of the variance.
The authorization of this variance would not cause any detriment to
the area at all. There would be no increase in houses or traffic ,
there would be no increase in the number of parcels , there would not
even be a change in the residents of the home. The only thing the
authorization of the variance would do is ( CONTINUED ON ATTACHED)

Zoning Appeals, if sufficient information necessary to this review
has not be submitted by the deadline.

DESCRIPTION OF REQUEST (CONTINUED) :
of the more than forty acres he owns. We are recording two plats
(copies attached) at the time the deed is to be recorded. One
shows the "new" parcel, and the other is a composite map of Mr.
Blencowe's remaining property. He owns two adjacent parcels. The
smaller one is to be merged into the larger property, and the
parcel he is selling to us is to be divided off and renamed with
the parcel number of the smaller parcel that is being merged into
the large piece. In summary, the total number of parcels will
remain the same.
The reason we are requesting a variance is because the house
has small, seasonal streams on each side and in front which flow
into the Moorman's River and the mountain rises up almost immedi-
ately behind the house, so there is no area on the parcel suitable
for another drainfield. Because of the geography of the particular
parcel, there is not any area immediately adjacent to the property
we are purchasing which could also be purchased which would be
suitable for a backup drainfield. Therefore, because of the
steepness of the grade and the fact that we are located in a
"watershed conservation area, " no area for a drainfield exists
other than the drainfield currently in use.
The current drainfield has been maintained by us, and the
septic system functions perfectly.
JUSTIFICATION #1 (CONTINUED) :
completing the purchase this Spring, we have spent more than
$6,289. 00 to get a survey and to obtain funds for closing.
($4,839.00 of this cost was for taxes and withdrawal penalties to
get funds from a retirement plan. )
JUSTIFICATION #3 (CONTINUED) :
allow us to assume ownership of the house we have occupied for more
than a decade. The subdivision we are asking for would give us
essentially what we (and our landlord) have always seen as the
parcel of land which belongs with our house.
