Signe ure Date Receipt# Date 0 411 DESCRIPTION OF REQUEST : The applicant proposes to expand the existing Putt-Putt Golf & Games . Improvements include renovation of the existing Putt-Putt Golf Course ( built in 1966 , prior to a zoning ordinance and within fifty feet of property line ) , bumper boats , batting cages and a go-cart facility . In order to remodel and expand our business of 34 years and insure internal control and public safety , I request a variance from the 50 foot property line set back . 1 ) The strict application of this ordinance goes beyond the intent of the ordinance for the proposed remodeling and expansion of the existing use . Since the adjoining property has been all commercial use for over 25 years and the fact that the Comprehensive Plan recognizes it a office-commercial , it would create an undue hardship on the existing business use if strict compliance of the 50 foot set back is required . Therefore , it seems that the existing use should be exempt from this section of the ordinance . 2 ) This hardship is unique to this use and this zone and this property . This hardship is not shared by any other property in this zoning district or vicinity . 3 ) The proposed remodeling and expansion of the Putt-Putt Golf & Games will not be a detriment to adjacent property as the building set back lines and uses will conform . The putting surfaces , batting surfaces and bumper boats are more similar to parking surfaces than to buildings . If this variance is granted , the character of the district will remain the same as it has been for over twenty-five years . The original zoning dividing line,was somewhat arbitiary, and now that the property is being developed, portions of both the C-1 and R-15 property w be unusable without a zoning line adjustment.
