Unfortunately, this diagram shows that there is a little more than 50% of reserve area located on lot 2, less than we were originally told. When I spoke with Gary, he told me that the proposed house site could not be moved further back on the lot because of the location of the existing well. As you can see from the diagram, both the homesite and the primary drainfield area have been held as close as possible to the existing well. Gary told me that it was not possible to locate a primary drainfield area and a 100% reserve area on Lot 2 because of the location of the existing wells, power lines, and the rocky soil conditions on parts of the lot. We have attempted to obtain an easement from the owner of Lot 1, but he has been unwilling to grant us an easement for reserve area for a drainfield. While we will continue to pursue an easement from the owner of Lot 1, it does not appear likely that we will be able to resolve the matter this way. I would like to point out, as Gary reiterated to me, that while we do not meet Albemarle County's requirement for a 100% reserve area, we do meet the State's requirement of a 50% reserve.
