RECFIVEt ALBEMAhLi: WW1' ZONING DERi:*116 Z c Road•Charlottesville,Virginia 22901.804-973-3377•Fax 804-973-2573 I 4 J C HRobert user omes June 30, 1994 Ms. Babette Thorpe Albemarle County Department of Zoning 401 McIntire Road Charlottesville, VA 22902-4596 RE: Variance Application, VA-94-02 Tax Map 62, Parcel 93 Dear Babette: This week I received a diagram from Mr. Gary Rice of the Albemarle/ Charlottesville Health Department detailing the location of a proposed drainfield area for a primary septic system, and the required reserve area for the home Claude and Lois Sandy have proposed to build on Lot 2. Unfortunately, this diagram shows that there is a little more than 50% of reserve area located on lot 2, less than we were originally told. When I spoke with Gary, he told me that the proposed house site could not be moved further back on the lot because of the location of the existing well. As you can see from the diagram, both the homesite and the primary drainfield area have been held as close as possible to the existing well. Gary told me that it was not possible to locate a primary drainfield area and a 100% reserve area on Lot 2 because of the location of the existing wells, power lines, and the rocky soil conditions on parts of the lot. We have attempted to obtain an easement from the owner of Lot 1, but he has been unwilling to grant us an easement for reserve area for a drainfield. While we will continue to pursue an easement from the owner of Lot 1, it does not appear likely that we will be able to resolve the matter this way. I would like to point out, as Gary reiterated to me, that while we do not meet Albemarle County's requirement for a 100% reserve area, we do meet the State's requirement of a 50% reserve. With the diagram and statements from Gary Rice, it appears to me that if Albemarle County's Zoning Ordinance is strictly enforced, it will result in the "taking" of Lot 2, and we should therefore be granted our requested appeal. 2401 Hydraulic Road•Charlottesville,Virginia 22901 •804-979-7334•Fax 804-979-7443 Please forward this information to whomever will be handling this case in the future. We have not yet received the information we have requested from the Health Department concerning the final calculation of the percentage of the required septic reserve.
