DESCRIPTION OF REQUEST: WE ARE REQUESTING FOR AN ADJUSTMENT ON THE OVERALL HEIGHT
OF THE FREESTANDING SIGN THAT ARE ALLOWED. THE MAXIMUM
HEIGHT OF A FREESTANDING SIGN IS NORMALLY 12' . WE ARE ASKING
FOR 20'
JUSTIFICATION SHALL BE BASED ON THESE THREE (3) CRITERIA:
1) That the strict application of this ordinance would produce undue hardship.
PLEASE SEE ATTACHED NOTE
2) That such hardship is not shared generally by other properties in the same zoning district and the same
vicinity.

3) That the authorization of such variance will not be of substantial detriment to adjacent property and that
the character of the district will not be changed by the granting of the variance.

1 ) THAT THE STRICT APPLICATION OF THIS ORDINANCE WOULD PRODUCE
UNDUE HARDSHIP FOR TWO REASONS .
A) THERE IS A RETAINING WALL THAT RUNS ALL ALONG THE FRONT
PROPERTY OF THE OUTBACK STEAKHOUSE BUILDING. THIS RETAINING WALL
IS APPROXIMATELY 4 ' FROM THE US ROUTE 29 SIDE. ON THE OUTBACK
STEAKHOUSE SIDE OF THE RETAINING WALL THE GROUND SLOPES DOWN AS YOU
ARE GOING TOWARDS THE BUILDING. AT 5 ' SETBACK WHICH IS WHAT IS
REQUIRED FOR THE SIGN SETBACK PER THE COUNTY, THE GROUND LEVEL IS
APPROXIMATELY 7 ' FROM GROUND TO THE TOP OF THE RETAINING WALL. IF
THE SIGN IS TO REMAIN 12 ' OVERALL HEIGHT ONLY APPROXIMATELY 3. 6 '
OF THE SIGN WOULD ACTUALLY BE VISIBLE .
B) THE ARCHITECTUAL REVIEW BOARD IS REQUIRING "STREET TREES"
TO BE PLANTED, THESE STREET TREES ARE OF "REQUIRED SPECIES" , IN
THIS CASE SUGAR MAPLES WHICH AR 14 ' TALL AND 3" IN CALLIPER AT
PLANTING. THIS WILL POSE EVEN A GREATER HARDSHIP DUE TO THE FACT
THAT THE TREES WILL BE TALLER THAN THE SIGN AND WILL TOTALY BLOCK
ALL VISIBILITY OF THE "OUTBACK STEAKHOUSE" SIGN.
IF THE SIGN IS AT 20 ' OVERALL HEIGHT, WE WILL BE ABLE TO OVERCOME
ALL THESE OBSTACLES.
2) THIS HARD SHIP WILL NOT BE SHARED BY OTHERS DUE TO THE FACT
THAT THE RETAINING WALL ONLY RUNS IN FRONT OF THE OUTBACK
STEAKHOUSE RESTURAUNT.
3) THIS VARIANCE WILL NOT BE OF SUBSTANTIAL DETRIMENT TO ADJACENT
PROPERTY AND THE CHARACTER OF THE DISTRICT WILL NOT BE CHANGED
BECAUSE WE HAVE MET ALL CITY REQUIREMENTS AND WILL NOT BE AN
"EYESORE" TO THE PUBLIC.
