Request for Special Exceptions to ZMA200400007 Belvedere
Code of Development and Application Plan (Variations #58)

NMD Neighborhood Model
The applicant is requesting three special exceptions to the Belvedere Code of Development and
Application Plan approved with ZMA200400007. The applicant's proposal is provided as
Attachment A. County Code § 18- 8.5.5.3 allows minor variations to codes of development
and application plans, provided major elements and features remain the same.
Variation #58 proposes modifications the Architectural Standards of the Code of
Development to address the following:
- Clarify that chain link fence is prohibited on residential lots but permitted to fence
facilities, open spaces/parks (stormwater mgt., dog parks, tot lots, etc.);
- Modify required dimensions for front porches to allow more flexibility in design to
better address townhouse/attached unit designs;
- Modify review processes for the Belvedere's internal Architectural Neighborhood
Standards Committee;
- Simplified the document by eliminating the language of one of two redundant
sections in the Architectural Standards that addressed Massing guidelines (no
substantive changes to the guidelines occurs with the change);
- Delete vinyl as a permitted siding material;
- Other technical corrections/updates (references to current owner's names; updated
tax map/parcel numbers, etc.).
Staff analysis of the request is provided as Attachment B.
RECOMMENDATION: Staff recommends that the Board adopt the attached Resolution
(Attachment C) approving the special exception.
