RE: SP201800015 Albemarle Montessori School
Dear Mr. Melton:
Staff has reviewed your initial submittal for a Special Use Permit to establish a Montessori School
at 1562 Insurance Lane in the Hollymead PUD.
We have some questions and comments which we believe should be resolved or included as
conditions of approval before your proposal goes to public hearing. We would be glad to meet with
you to discuss these issues. Our comments are provided below:
Special Use Permit
1. Indicate (in a note or labeled on site plan) how many parking spaces correspond with the
existing day care use, the vacant office suite, and the proposed Montessori School. Include
how many parking spaces will ultimately correspond with the Montessori School.
2. The Zoning Administrator shall determine the required number of parking spaces per
Section 4.12 of the County's Zoning Ordinance and shall require a parking study, including
information on traffic circulation and curbside pickup and drop off locations.
3. A shared parking agreement for special events will require approval from the Zoning
Administrator and an instrument from the businesses/owners that would be included in the
shared parking agreement.
4. The applicant's proposed traffic pattern to circulate around the building will require a
designated curbside pickup and drop off location, which must be shown on a general
concept plan. This pickup and drop off location will likely reduce the available number of
parking spots, but may not reduce the available parking spots below the required parking
numbers.
Planning
Planning Staffs comments are organized as follows:

Comprehensive Flan. initial comments on how your proposal generally relates to the
Comprehensive Plan are provided below. Comments on conformity with the Comprehensive Plan
are provided to the Planning Commission and Board of Supervisors as part of the staff report.
The Places29 North Master Plan designates the parcel as Commercial Mixed Use, which include
institutional uses. Commercial Mixed Use is meant to support existing Centers and encourage
future mixed -use development. While institutional uses are listed as secondary uses in the Master
Plan, adjacent secondary uses already exist, including office uses. Secondary uses are meant to be a
smaller proportion in the designated than primary uses, however there are currently no primary uses
in any of the adjacent or nearby parcels, such as retail or auto commercial sales. As stated in the
Master Plan: "These areas have the potential to integrate some nonretail uses, such as multifamily
housing, office, or institutional uses."
The proposed use is consistent with the Master Plan designated adjacent uses of Neighborhood
Density Residential and Urban Density Residential. Both list institutional uses as secondary uses.
The proposed school would be consistent with the character of these designations.
Planning Comments
1. The need for additional applications is not anticipated. The only proposed changes are the
use of the property and changes to the interior of the building. At the community meeting, it
was mentioned that the Montessori School does not anticipate expansion into additional
buildings or parcels at this time, however if this were to change then additional applications
may be required.
2. Indicate (in a note or labeled on site plan) how many parking spaces correspond with the
existing day care use, the vacant office suite, and the proposed Montessori School. Include
how many parking spaces will ultimately correspond with the Montessori School.
3. The Zoning Administrator shall determine the required number of parking spaces per
Section 4.12 of the County's Zoning Ordinance and shall require a parking study, including
information on traffic circulation and curbside pickup and drop off locations.

5. Correct the proposal to indicate a start time of 7:15 AM, as was provided at the community
meeting.
6. Update the proposal to indicate the number and types of rooms, if these have changed since
the initial application. There appeared to be some changes made between the initial
application and the community meeting.
Zoning
The following comments related to zoning matters have been provided by Lea Brumfield:
1. The applicant's proposed traffic pattern to circulate around the building will require a
designated curbside pickup and drop off location, which must be shown on a general
concept plan. This pickup and drop off location will likely reduce the available number of
parking spots, but may not reduce the available parking spots below the required parking
numbers.
2. Applicant needs to address the parking considerations for afterschool or special events
activities, such as parent association meetings, family days, student presentations and
performances, etc. Please provide the total parking available and the total parking required
in a parking study.
3. The narrative provided asserts that parents will pick up their elementary aged children
between 12 noon and 5:45 pm. Please address this, as a day ending at 12 noon would not
provide a full day of school. Albemarle County requires a minimum of a 5.5-hour school
day. The State Code of Virginia Section 22.1-254 requires that private school students
attend the same number of days and hours as public school students. Recommendation: The
increased number and higher ages and sizes of the children in primary school grades may
require larger or different play equipment and a larger size of playground. The applicant
should address this aspect of playground use.

that need to occur and additional information requested. Once conditions are drafted, staff will send

Notification and Advertisement Fees
Prior to scheduling a public hearing with the Planning Commission, payment of the following fees
is needed:
$546.00 Cost for newspaper advertisement
$215.00 Cost for notification of adjoining owners (minimum $200 + actual postage/$1 per owner
after 50 adjoining owners)
$761.00 Total amount due prior to Planning Commission public hearing
Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for the
Board hearing needed.
$546.00 Additional amount due prior to Board of Supervisors public hearing
$1,307.00 Total amount for all notifications Fees may be paid in advance. Payment for both the
Planning Commission and Board of Supervisors public hearings may he paid at the same time.
Additional notification fees will not be required unless a deferral takes place and adjoining owners
need to be notified of a new date.

August 20, 2018, and find it to be generally acceptable.

Please consider the following comments regarding the above SP application:

DEPARTMENT OF COMMUNITY DEVELOPMENT
ACTION AFTER RECEIPT OF COMMENT LETTER
FIRST SET OF COMMENTS
Your project has been tentatively scheduled for a public hearing by the Planning Commission for
December 4, 2018, which is 90 days from the date your application was accepted for review. State
Code requires a 90-day review by the Planning Commission unless the applicant requests deferral. As
you will read in this comment letter, staff recommends changes to your project to help you achieve
approval. Without these changes, staff cannot recommend approval to the Planning Commission.
If you need more time to make these changes, you must request deferral by November 9, 2018. If you
choose not to request deferral, staff will take your project to the Commission as originally submitted,
but without a recommendation of approval. Instructions for requesting a deferral are outlined below.
If you submit all of the requested changes in the review comments by October 261h, 2018, this may
give Staff enough time to review the changes and incorporate them into the Staff Report, with a
recommendation of approval for the December 41h Planning Commission hearing. Otherwise, Staff will
inform you that you should defer on or before November 9tn
Please do one of the following on or before November 9, 2018:
(1) Request deferral, as required by Section 33.52, in these instances:
a. If this is an application with a submittal date on or after September 5, 2018 and
you have not deferred to date, and you would like to submit revised application
materials.
(2) Proceed to Planning Commission public hearing on December 4, 2018
(3) Withdraw your application
(1) Deferral Reguest and Resubmittal
To request deferral, you must submit a request in writing to defer action by the Planning Commission
and Board of Supervisors. The request may be made by email. You may request a deferral for up to 36
months from the date your application was accepted for review, which is September 5, 2021. (This is
based on the Board of Supervisors' September 5, 2018 action.) However, all outstanding information
necessary for Commission action must be submitted on or before May 5, 2021 according to the
published schedule. (See Section 18-33.52 of the Albemarle County Code.)

Be sure to include the resubmittal form on the last page of your comment letter with your submittal.
The application fee which you paid covers staff review of the initial submittal and one resubmittal.
Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.)
(2) Proceed to Planning Commission Public Hearing on December 4 2018
At this time, you may request that your application proceed to public hearing with the Planning
Commission on December 4, 2018. With this option, staff will take your project to the Commission as
originally submitted, but without a recommendation of approval.
(3) Withdraw Your Application
If at anytime you wish to withdraw your application, please provide your request in writing.
Failure to Respond
An application shall be deemed to be voluntarily withdrawn if the applicant requests deferral pursuant
to subsection 33.52(A) and fails to provide within 90 days before the end of the deferral period all of
the information required to allow the Board to act on the application, or fails to request a deferral as
provided in subsection 33.52(8) or (C).
Fee Payment
Fees paid in cash or by check must be paid at the Community Development Intake Counter. Make
checks payable to the County of Albemarle. Do not send checks directly to the Review Coordinator.
