RE: SP201900007 Tandem Friends School Pavilion
Dear Mr. Adams:
Staff has reviewed your initial submittal for the special use permit, SP201900007, Tandem Friends School Pavilion. We
have a number of questions and comments which we believe should be addressed before we can recommend favorably on
your SP request. We would be glad to meet with you to discuss these issues.
Review comments are provided below, organized by Department, Division, or agency. Our comments are provided below:
Planning — General Application Comments
1. It is recommended that more information on the proposed middle school area from SP2015-00021 be included on
the concept plan for this application as well, because the concept plan for this special use permit, if approved by
the Board of Supervisors, will take precedence over all previous special use permits. Elements include the
proposed size and height of the middle school, and the stormwater management facility shown on the previous
concept plan. (Also see comments from the Zoning division and the Engineering division, which are attached.)
2. Clarify what the narrative means by "open -type pavilion." Will this structure always be open to the elements, with
no walls, or will there be some type of folding doors or temporary walls that can put into place to protect the
space during cold or inclement weather? In addition, as it is mentioned that there will be two stories, identify
whether both stories will be open, or just the top floor.
3. Clarify on the concept plan the number of stories proposed for the structure. The concept plan as currently
submitted indicates the building will only be one story. However, the narrative states that the pavilion may be two
stories on the eastern side. Is it proposed for this structure to be built into the grade of the land? In addition, are
different uses proposed within each of the two stories? Or are they both proposed to be open assembly spaces?
4. Please be aware of setback requirements for this property, which is zoned R-1 Residential and is subject to the
setback requirements found in 4.19 of the Albemarle County Zoning Ordinance.
5. There appear to be Managed Steep Slopes in the vicinity of the proposed pavilion. Identify where those slopes are
so that staff may determine whether they will be disturbed by this project. Also include in the project narrative if
it is anticipated that this project will affect any managed steep slopes.
6. Include in the zoning note on the concept plan that this property also lies within the Entrance Corridor and the
Steep Slopes -Managed overlay districts.
7. It does not appear that there are any proposed transportation changes on the site regarding this proposed new
building. However, are any new bike paths, sidewalks, or pedestrian paths proposed to connect this pavilion with
the rest of the campus?
8. Please be aware of fire -rescue requirements for access to buildings. See the comments from Shawn Maddox of
Albemarle County Fire-resuce, which are included near the end of this letter. Fire -Rescue will review any site
plans for proposed improvements on this property when submitted, and all new buildings must meet their access
requirements.
9. Please clarify note number 4 provided for the new concept plan, which discusses building envelopes. What is the
purpose of the statement to "see parking spaces..."? Is this comment based on the required parking numbers for
the school, or for some other reason?
10. Indicate on the concept plan what the land use designation in the Comprehensive Plan is for this property, as well
as what is allowed within this land use designation.
I t . The narrative mentions that the new building will be used for dining facilities. Will there also be kitchen facilities
located in this structure?
12. Are bathroom facilities proposed to be located in this building? If so, please include this accessory use in the
project narrative. The project narrative states that no new public utility extensions are anticipated; however; new
kitchen or bathroom facilities in the structure will require water and sewer lines approved by the Albemarle
County Service Authority to serve them. However, the design of these utilities will be addressed at the site
planning stage.
13. If outdoor lighting is proposed, a lighting plan that complies with section 4.17 of the Albemarle County Zoning
Ordinance will have to be submitted as a part of the site plan at that stage of development.
14. Provide more information in the project narrative about whether this project will have any impact on public
services such as police or fire protection.
15. Conditions for this special use permit have not been written by staff at this time; however, they will be provided
for review by the applicant prior to the first public hearing, whenever that may be scheduled. It is likely that, at a
minimum, all existing conditions from SP2015-00021 will continue with this proposed special use permit, except
for those conditions that specifically reference the original concept plan. Those conditions will be revised to
reference the proposed new concept plan. The condition on the maximum enrollment number will remain, as that
condition is not proposed to be amended with this SP application.
16. Please be advised that site plans and VSMP plans, or some type of amendment, will be required at the site
development stage if this special use permit is approved by the Board.
Comprehensive Plan
Initial comments on how your proposal generally relates to the Comprehensive Plan are provided below. Comments on
conformity with the Comprehensive Plan are provided to the Planning Commission and Board of Supervisors as part of
the staff report.
The Southern and Western Urban Neighborhoods Master Plan identifies Tax Map Parcel (TMP) 09100-00-00-002AO as
Neighborhood Density Residential land use. This classification calls for primary uses to consist of residential uses at 3-6
units per acre. Secondary uses in this classification include supporting uses such as places of worship, schools, public and
institutional uses, and small-scale neighborhood serving retail and commercial. The existing use of a private school on this
property is consistent with the master plan's recommendation for secondary uses, which includes schools and institutional
uses. The proposed addition of one building, as requested in this special use permit, to the school campus continues the
consistency of the use with the master plan's recommendations. In addition, the Tandem Friends School property is within
a Priority Area as designated in the master plan, although the recommendations of the Priority Areas are not applicable to
this request.
Neighborhood Model
Projects located within the Development Areas are typically reviewed for consistency with each of the Neighborhood
Model Principles found in the Comprehensive Plan. Comments are provided below on relevant aspects of the
Neighborhood Model. More detailed comments may be provided after more detailed plans are provided.
Pedestrian Orientation This principle is met. The existing vehicular traffic circulation pattern is not proposed to
be changed with this request. Sidewalk connections are proposed between the new
building and the existing school buildings.
Mixture of Uses
This principle is not applicable to the request. The proposal is to add one building to an
existing school campus. However, this additional building may allow for a greater
variety of uses on the campus through additional dining location options and different
options for meeting spaces or other school functions.
Neighborhood Centers
This principle is met. The Tandem Friends School is adjacent to a designated
neighborhood center at the collection of County buildings on Mill Creek Drive. The
school provides an additional community focal point in this neighborhood, with
educational and community gathering opportunities on the campus.
Mixture of Housing Types
This principle is not applicable to the request. No housing is proposed with this request.
and Affordability
The request is to add one building to an existing private school campus.
Relegated Parking
This principle is not applicable to the request. No new parking is proposed with this
request.
Interconnected Streets and
This principle is not applicable to the request. No new streets or transportation networks
Transportation Networks
are proposed with this request to add one additional building to an existing school
campus.
Multimodal Transportation
This principle is not applicable to the request. The request is to add one additional

building to an existing school campus, with no proposed changes to traffic circulation or
transportation changes. Pedestrian connections to the new building are proposed from
the rest of the campus.
Parks, Recreational
This principle is not applicable to the request. One building is proposed to be added to
Amenities, and Open Space
an existing school campus. There are existing outdoor recreational amenities on the
campus, and this proposal does not affect them.
Buildings and Spaces of
This principle is met. The conceptual plan shows one additional building being added to

the school campus, and the narrative indicates that it will be built into the grade, with
sidewalks or other pedestrian paths connecting the new building to the rest of the
campus.
Redevelopment
This principle is met. The property currently contains a private school campus. The
proposal is to add one additional building to the campus.
Respecting Terrain and
This principle is met. The property contains managed steep slopes. It does not appear

that the managed slopes will be affected by this proposal. However, if they are affected,

occur, must meet the requirements of Albemarle County Code during the site plan stage
of any potential development plan and obtain approval for disturbing steep slopes from

Clear Boundaries Between
This principle is not applicable to the request. The subject property is located within the

Planning - Transportation

Zoning Division, Community Development Department

Engineering & Water Resources Division, Community Development Department
The following comments regarding this proposal have been provided by the County Engineer, Frank Pohl,
ffpohl(&albemarle.org.
Even though this phase is less than 10,000 sf of land disturbance, the area of land disturbance associated with the new
middle sch ool (SP201500021) must also be included. Projects cannot be phased to avoid VSMP/VESCP requirements.
VSMP plan approval is required before the site plan amendment can be approved. Please schedule a meeting with
Engineering to discuss submittal options.
E911, Community Development Department

Albemarle County Architectural Review Board (ARB)
The following comments regarding this proposal have been provided by Margaret Maliszewski, staff planner for the ARB,

No objection; this pavilion is not expected to be visible from the Entrance Corridors.
Building Inspections Division, Community Development Department
The following comments regarding this proposal have been provided by the Building Inspections plans reviewer, Michael
Dellinger, mdellingergalbemarle.org.
We will required engineered drawings and foundation for the buildng permit application. Other than this note I have no
objection.
Albemarle County Fire -Rescue
The following comments regarding this proposal have been provided by the Fire & Rescue plans reviewer, Shawn
Maddox, smaddoxgalbemarle.org.
Fire Rescue has no objections to the amendment of the special use permit. The following comments will need to be noted
during the site plan process:
1. If the building is going to exceed 30' then the travel way will need to be 26' of unobstructed travel width.
2. Fire apparatus will have to be able to get within 150' of every side of the building for hose deployment.

Please consider the following comments regarding the above SP application:
Please expand upon the intended uses of the pavilion and the potential impacts to neighboring
parcels. Specifically, address:
a. Food preparation and eating
Will there be any food preparation in the pavilion? If so, note this in the narrative. This
may impact the Building Official's approval of this use in this type of structure in this
location.
b. Sanitary facilities
Will there be any sanitary facilities located in the pavilion? If so, are the current water
and septic lines located near the site sufficient for the use proposed?
c. Meeting space
In our previous pre -application meetings, you described an intention to use the space
for meetings and performances, some of which may be at night. Will there be lighting
and a sound system installed? Due to the open air nature of the pavilion, if there will be
lighting and a sound system installed, the use must comply with the Lighting regulations
in Chapter 18 Section 4.17 of the Albemarle County Code, including the positioning of
all lighting "shall be arranged or shielded to reflect light away from adjoining residential
districts and away from adjacent roads." (18-4.17.4(b)(2))
Additionally, if the space will be used for performances and meetings with the use of
amplified sound after school hours in the evening, recommended conditions will include
compliance with the decibel limitations described in the Noise regulations of Chapter 18
Section 4.18.04, and a curfew to end all amplified sound at 10pm Monday through
Thursday, and at 11 pm Friday and Saturday.
2. The details of SP201500021 are removed from this plan, and the conditions of approval are
not listed on this plan. This submission does not propose to amend the approval or conditions
of the previously approved middle school addition in SP201500021, and is not being reviewed
for any amendments to the details of that plan. Replace the details of that concept plan on this
new concept plan unless the details of the middle school addition are also under review in this
submission.
ALBEMARLE COUNTY COMMUNITY DEVELOPMENT — Information from Service Providers
To be filled out by ACSA for ZMA's and SP's
1) Is this site in the jurisdictional area for water and/or sewer? Yes
2) What is the distance to the closest water and sewer line, if in the jurisdictional area? Parcel is
currently served by water and sewer.
3) Are there water pressure issues which may affect the proposed use as shown on plan?
4) Are there major upgrades needed to the water distribution or sewer collection system of which the
applicant and staff should be aware?

Dear Mr. Reitelbach:
The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced special use permit amendment dated 15 July 2019,
and offers no comments at this time. The proposal to construct a new pavilion does not appear to
impact total enrollment or otherwise impact transportation, nor does the plan propose any work
within existing right of way.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the Charlottesville Residency Transportation and Land Use
Section at (434) 422-9399 for information pertaining to this process.

ACTION AFTER RECEIPT OF COMMENT LETTER
FIRST SET OF COMMENTS
Your project has been scheduled for a public hearing by the Planning Commission for October 22,
2019, which is 84 days from the date your application was accepted for review. State Code requires a
90-day review by the Planning Commission unless the applicant requests deferral. As you will read in
this comment letter, staff recommends changes to your project to help you achieve approval. Without
these changes, staff cannot recommend approval to the Planning Commission.
If you would like to address the comments, you must request deferral by September 20, 2019. If you
choose not to request deferral, staff will take your project to the Commission as originally submitted,
but without a recommendation of approval. Instructions for requesting a deferral are outlined below.
Please note that you can submit revisions even if you defer your application.
Please do one of the following on or before September 20, 2019:
(1) Request deferral to resubmit to address comments, pursuant to Section 33.52(A)(1).
Please understand that if a deferral request is made, the Planning Commission public
hearing date will be later than October 22, 2019.
(2) Request to proceed to a Planning Commission public hearing on October 22, 2019. All
advertising fees must be paid by September 20, 2019.
(3) Withdraw your application.
(1) Deferral Request and Resubmittal
To request deferral, you must submit a request in writing to defer action by the Planning Commission
and Board of Supervisors. The request may be made by email. You may request a deferral for up to 36
months from the date your application was accepted for review, which is July 31, 2022. However, all
outstanding information necessary for Commission action must be submitted by April 1, 2022,
according to the published schedule. (See Section 18-33.52 (A)(2) of the Albemarle County Code).

(2) Proceed to Planning Commission Public Hearing on October 22, 2019
At this time, you may request that your application proceed to public hearing with the Planning
Commission on October 22, 2019. With this option, staff will take your project to the Commission as
originally submitted, but without a recommendation of approval.

If at any time you wish to withdraw your application, please provide your request in writing.
Resubmittals
As stated above, a deferral does not preclude you from resubmitting the application to address
changes based upon the comments. If you would like to resubmit after you defer, you may do so
following the resubmittal schedule. Be sure to include the resubmittal form on the last page of your
comment letter with vour submittal.
The application fee which you paid covers staff review of the initial submittal and one resubmittal.
Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.)
Failure to Respond
An application shall be deemed to be voluntarily withdrawn if the applicant requests deferral pursuant
to subsection 33.52(A), and fails to provide within 120 days before the end of the deferral period all of
the information required to allow the Board to act on the application. (See Section 18-33.53 (C) of the
Albemarle County Code).
Fee Payment
Fees paid in cash or by check must be paid at the Community Development Intake Counter. Make
checks payable to the County of Albemarle. Do not send checks directly to the Review Coordinator.
