The site plan may be reviewed under the last zoning approval for the property. That means that the previous approval to disturb slopes remains valid. The disturbance of slopes over 25% that were created as a result of grading activity may occur with no additional discretionary review. The long and short of this is — The grading you are proposed may be approved once all the WPO and site plan issues are resolved. There is no critical slope or steep slope issue. William D. The plan was for Town Centers 3 and 4 at the UVA Research Park. A minor amendment was also approved for a phasing plan that separated Town Centers 3 and 4. Town Center 3 has been built and Town Center 4 has not yet been constructed. We would like to confirm a couple of things: 1. Would you please confirm that this site plan (SDP 2006-113) is still valid? The plan was approved May 4, 2007. Therefore, it was valid on January 1, 2oo9 and on January 1, 2011 due to the language in the attached links. http://lis.virginia.gov/c i- bin/legp6o4.exe?ogl+ful+CHAPo1A6 and http://law.lis.virginia.gov/vacode/title15.2/chapter22/section15.2-220�.1/ and it will remain valid until July 1, 2017. 2. Would you also confirm if the critical slope waiver that is associated with the site plan is still valid? The critical slope waiver is a component of the site plan that remains valid as long as the site plan is valid. 3. If the critical slopes waiver is still valid, would you also confirm that an amendment to this site plan could disturb the "preserved" slopes in a similar fashion as the previously approved plan? It may not be disturbed in a "similar fashion". The language of the ordinance 30.7.4 states: 30.7.4 PERMITTED USES The following uses and structures are permitted by right or by special use permit on managed or preserved slopes, provided that the land disturbing activity to establish the use or structure complies with design standards in section 30.7.5 and all other applicable requirements of the Code: b. Preserved slopes. The uses permitted by right and by special use permit on preserved slopes are as follows, subject to the applicable requirements of this chapter: By right. The uses permitted by right on preserved slopes are the following: g. Legislative zoning actions related to the underlying district. Any use or structure approved by the board of supervisors in a zoning map amendment whose location is expressly authorized in an approved application plan, code of development, or an accepted proffer, in a special use permit authorized in the underlying district regulations, or in a special exception authorizing a waiver or modification of the requirements of section 4.2.3; provided that the legislative action is still valid and that the use or structure complies with all requirements and conditions approved or imposed in conjunction with the legislative zoning action. The disturbance will have to meet the design standards in section 30.7.5 and any conditions imposed with the original approval (I do not know if any were imposed.) The area of disturbance cannot be expanded beyond the area shown to be disturbed when the waiver was granted. If you have any other follow-up questions, please let me know. Thanks!
