Subject: Lighthouse Instruments — Easement Plats
(SUB201900090; SUB201900091; SUB201900092; and SUB201900093)
The County of Albemarle Planning Division will grant or recommend approval of the plats referenced above once the
following comments have been addressed. Each comment is preceded by the applicable reference to the Albemarle County
Code Chapter 14 (Subdivision Ordinance) or Chapter 18 (Zoning Ordinance), unless otherwise specified. This review
comment letter contains comments for each easement plat application listed above, as well as comments from staff in the
County Attorney's Office pertaining to each corresponding deed or agreement for the various easements shown on these
multiple easement plat applications. Previous review comments which have previously been addressed have been removed
from this letter for clarity and simplicity.
County Attorney's Office —
Review Comments for Deeds shown on Easement Plats SUB-2019-90, -91, -92, and -93:
In coordination with staff in the Engineering and Planning Divisions of the Community Development Department, the
County Attorney's office provides the following required changes to the six draft deeds of easement for various public
easements associated with and depicted on the following attached 4 easement plats: SUB2019-90 - Easement Plat,
SUB2019-91 - Easement Plat, SUB2019-92 - Easement Plat, and SUB2019-93 - Easement Plat.
Lighthouse Sight Distance Easement v2
a. Opening Recital — McIntire Road is spelled with an "i."
b. Property Description — The deed and plat references are reversed. DB 418/435 should be referenced at
the end of the first paragraph, and DB 5002/78 at the end of the second.
c. Second Whereas
i. Substitute "Lighthouse Land, LLC" (and its parcel number) for "Astec Partnership" (and its
parcel number) in the plat title.
ii. The sight easement is shown on page 5 of the Lighthouse plat.
d. "Now, Therefore" — Given the use of the term "Sight Easement" throughout the rest of the deed, the
defined term here should likewise be "Sight Easement."
e. Page 1, last paragraph — Include a close quote (") after "(219 SQ. FT.)"
f. Signature Lines:
i. Substitute Lighthouse Land, LLC for Astec Partnership.
ii. Use the County Executive's full name: Jeffrey B. Richardson.
2. Lighthouse Landscape v2
a. Property Description — The plat title in the description differs from the plat's actual title. Use the plat's
actual title.
b. "All landscaping and screening shall be maintained in a healthy condition by the County, and replaced
when necessary. Replacement material shall comply with approved landscape plan." This landscape
easement should not impose affirmative obligations on the County; please remove this language.
c. County Acceptance — This deed should include the same County acceptance language as the sight
distance easement.
d. County Executive signature — Include a signature line for the County Executive.
e. County Attorney approval as to form — Include a signature line for the County Attorney to approve as to
form.
f CDD-Planning note (9/27/2019): Staff acknowledges the previous CDD-Planning review comment #16
for easement plat SUB201900090; however, upon final review, staff has determined that this "6' & 12'
landscape maintenance easement" is not required, and therefore the corresponding deed of dedication and
easement or similar instrument is not required or necessary. Please see updated CDD-Planning review
comments (Rev. Comm. #3 — dated 9/27) for easement plat SUB2019000090 (specifically, comments #4
and #16).
3. ASTEC — Sight Distance Easement v2
a. Opening Recital
i. The deed should specify that Astec Partnership is "a Virginia general partnership."
ii. McIntire Road is spelled with an "i."
b. Property Description
i. The surveyor was Thomas B. Lincoln (like the President)
ii. The plat is recorded at DB 1368, page 429.
iii. The deed into the Grantor was recorded December 14, 1993 at DB 1368, page 427.
c. Second Whereas -- The sight easement is shown on pages 3 and 4 of the plat.
d. "Now, Therefore" — Given the use of the term "Sight Easement" throughout the rest of the deed, the
defined term here should likewise be "Sight Easement."
e. Page 1, last paragraph — Include a close quote (") after "(2,235 SQ. FT.)"
f. Signature Lines -- Use the County Executive's full name: Jeffrey B. Richardson.
4. Additionally, because the County is not a party to any of the nine other deeds associated with the project, we have
no required changes to them; however, it's suggested that these deeds be forwarded to the involved parties (such as
the ACSA and the City), if they haven't already. Please confirm with CDD-Planning staff if these deeds have been
sent to the involved parties for review, and if the involved parties have granted their approval(s).
5. Additionally, attached are three FINAL deeds for the proposed stormwater drainage easements (on Lighthouse
Land property, on ASTEC Partnership property, and on Avon Court Holdings property); these are ready for
signature by the owners.
a. Note: Language relating to the fire truck turnaround access easement was removed from the drainage
easements.
b. Note (CDD-Planning/TP): Please see CDD-Planning comment #21 for easement plat SUB201900090
regarding the fire truck turnaround access easement and required deed of dedication and easement.
Once these deeds have been revised in accordance with the above comments, please resubmit them to me
(tnadalino(a)albemarle.org) for my distribution to the County Attorney for his review/approval. Whenever possible, please
do not resubmit the revised deeds to the County until all the easement plats have received tentative approval. And please
ensure that the coordination with the other involved parties is completed. Thank you.
Review Comments for SUB201900090 — Lighthouse Instruments — Easement Plat
("Various easements and reservation of right-of-way on the lands of Lighthouse Lands, LLC TMP 77-9"):
CDD-Planning — Tim Padalino
(Review Comment #3 — 9/27/2019): Requested Changes
[14-302(A)15] Identification of all owners and certain interest holders. If this plat seeks to vacate the VEPCO
easement, then the easement holder's signature shall be provided on the plat. VEPCO must authorize and be part of this
vacation.
Rev 1. While the easement is to be vacated through a separate instrument, until it is vacated the existing easement shall
be depicted, labeled, and provided recordation information on the plat.
Rev. Comm. #3 (9/27): Addressed - staff acknowledges the "Ex. Variable width VEPCO easement D.B. 1432 Pg.
13" identified on Sheet 3.
[14-302(A)5] Public Easements. Revise note #6 as follows: "This plat hereby dedicates to public use the ACSA
Waterline Easements, the site distance easements, the fire truck turn around easement, and the drainage easements
shown hereon. " This note shall reference the correct easement labels if they are modified.
Rev 1. When an easement is dedicated to public use it is conveyed to the County; however, there are a couple
easements lumped into note #6 that are not being dedicated to the County; rather, they are being dedicated to various
agencies other than the County, such as ACSA & Charlottesville Gas. Omit the ACSA waterline easement from note
#6 as all public water easements shall be dedicated to the Albemarle County Service Authority, and not to the County.
Also, omit the public gas line easement from note #6 and revise the easement label throughout the plat to no longer
label it as "public" and instead dedicate it to Charlottesville Gas. Additionally, the plat does not label or depict any
sight distance easements. Please remove reference to sight distance easements from note #6.
Rev. Comm. #3 (9/27): Partially addressed. Staff acknowledges the following: (A): References to easements to
ACSA and City Gas have been removed from Note 6. (B). A 1,026 SF sight distance easement is proposed on
Sheet 5. However, please further revise the plat as follows: (A). Please remove the "6' & 12' landscape
maintenance easement" from Sheets 3 and 5 and remove reference to this easement from Note 6 on Sheet 1.
Staff acknowledges the previous CDD-Planning review comment #16; however, upon final review, staff has
determined that this easement is not required — the proposed street trees (which satisfy the applicable
"landscaping along streets" requirements per County Code § 18.32.7.9.5) will be located on TMP #77-9 (the
private property of the applicant/owner/developer), and therefore do not need to be located in an easement.
Accordingly, the corresponding deed of dedication and easement for the 116' & 12' landscape maintenance
easement" is no longer required or necessary.
114-302(A)4, 14-3111 Private Easements. The site plan depicts a new gas line through the site. Provide an easement for
the gas line.
Rev 1. While a gas line easement has been provided. The easement shall not be dedicated to the County for public use;
rather, it shall be dedicated to Charlottesville Gas. Please revise the plat accordingly.
Rev. Comm. #3 (9/27): Addressed — staff acknowledges the 1115' gas line easement to Charlottesville Gas" on
Sheet 3.
14. [14-433, 14-303L, 14-317, 14-431, 14-428, 14-434, 14-435,14-435.11 The required deed of dedication and easement
associated with the public drainage easements shall be approved by the County Attorney prior to final plat approval.
Please submit an unsigned draft of the documents to staff and we will distribute it to the County Attorney's office for
review/approval. See attached template.
Rev 1. Comment not addressed.
Rev. Comm. #3 (9/27): Partially addressed — staff acknowledges the review and approval of this deed (and
others) is in progress; and specifically, staff has been notified that this deed of dedication and easement for
public drainages on the Lighthouse Land property is ready for approval and execution without any further
revision.
15. 114-434, 14-435, 14-435.1, 14-431, 14-311, 14-4281 Multiple plats have been submitted which depict the public right-
of-way dedication, associated public drainage easements, temporary construction easements, and all other required
easements for the construction and use of the public road. Prior to final plat approvals, all improvements necessary for
the construction, use, and maintenance of the public road shall be approved on a road plan and built or bonded pursuant
to Section 14-434, 14-435, and 14-435.1 of the Subdivision Ordinance.
Rev 1. Comment not addressed.
Rev. Comm. #3 (9/27): Partially addressed — staff acknowledges the road plan review and approval process for
application SUB201800044 is in progress.
16. 114-435, 14-435.1, 14-434, 14-311, 32.7.5] Street Trees. Street trees were previously approved to be located behind the
sidewalk, they may remain in this location. On this plat provide a 6' wide landscape and maintenance easement for
these trees, ensure the easement and the tree locations coincide. Provide a maintenance agreement for this landscape
easement.
Rev 1. Comment partially addressed. Ensure the easement is dedicated to the County for public use, as these street
trees are required with the public road. Label the easement as follows: "6 feet wide landscape maintenance easement
hereby dedicated to the County of Albemarle for public use. " The required deed of dedication and easement associated
with the landscape easement shall be submitted. The applicant is responsible for the development and recordation of
this document. The County Attorney will review the draft deed once the applicant provides them. The County
Executive shall sign the deed once ready for approval. The deed shall be recorded with the plat. Provide recordation
information on the site plan.
Rev. Comm. #3 (9/27): COMMENT WITHDRAWN. Staff acknowledges the previous CDD-Planning review
comment #16; however, upon final review, staff has determined that this easement is not required — the proposed
street trees (which satisfy the applicable "landscaping along streets" requirements per County Code §
18.32.7.9.5) will be located on TMP #77-9 (the private property of the applicant/owner), and therefore do not
need to be located in an easement. Therefore, please remove the 116' & 12' landscape maintenance easement"

Additional review comments on the revision:
17. 114-302(A)5, 14-3111 Public Easements. The drainage easements being dedicated to public use shall be labeled as
follows: "28 feet wide public drainage easement hereby dedicated to the County of Albemarle for public use. "
Rev. Comm. #3 (9/27): Addressed.
18. [14-302(A)5, 14-3111 Public Easements. Ensure all drainage easements required for the public right-of-way are labeled
as commented on in the previous review comment.
Rev. Comm. #3 (9/27): Addressed. Please note that the variable width drainage easement shown on Sheet 3
references the "Count [sic] of Albemarle" — please address the misspelling of "County." Thank you.
19. 114-302(A)5, 14-3111 Public Easements. The alignment and layout of the public drainage easement depicted on sheet
4, near L27, appears to cross TMP 77-7; however, the site plan does not depict this alignment for the easement; rather,
it cuts to the east onto TMP 77-9A and avoids crossing TMP 77-7. Revise to ensure the easement does not cross TMP
77-7 and is clearly depicted and matches the site plan.
Rev. Comm. #3 (9/27): Addressed on SUB201900090.
20. [Comment] Revise the title of the plat as follows: "Plat showing various easements, and the dedication and
reservation of public rights -of -way on the lands of Lighthouse Lands, LLC TMP 77-9. "

21. [14-433, 14-303L, 14-317, 14-431, 14-428, 14-434, 14-435,14-435.11 Rev. Comm. #3 (9/27): The required deed of
dedication and easement associated with the "variable width fire truck turnaround easement" must be
approved by the County Attorney prior to final plat approval. Please submit an unsigned draft of the
documents to staff and we will distribute it to the County Attorney's office for review/approval. If the deed
language for this easement has been incorporated into a different deed of dedication and easement, please
identify its location for County staff.
22. [14-303, 14-302.(A).5, 14-303.(L), 14-3171 Rev. Comm. #3 — (9/27): With the most recent submittal of the
corresponding final site plan (SDP201800070), staff has been made aware that the existing private sanitary
sewer lateral located on TMP #77-9A and partially in the Steep Slopes Overlay District does not have an

existing easement associated with that lateral's connection to the existing public RWSA infrastructure partially
located in the WPO Stream Buffer and Flood Hazard Overlay District. Prior to approval of final site plan
SDP201800070, please revise easement plat SUB201900090 to establish an easement over the proposed private
sanitary sewer line on TMP #77-9; and please revise easement plat SUB201900092 to establish an easement over
this existing sanitary sewer line on TMP #77-9A (for the benefit of TMP #77-9 and TMP #77-9A) all the way to
the point of connection with the existing RWSA infrastructure. A maintenance agreement shall be recorded
with the easement plats; based on information provided by the applicants during a meeting conducted with
County staff on Monday 9/23, the maintenance agreement has been finalized and is ready for approval (subject
to review and confirmation by the County Attorney).
CDD-Engineering — David James

■ I have no objection to the layout plan and easement layout sheets submitted. I had requested changes on the
easement plat that I forwarded to Chris Perez (uploaded to CV).

(Review Comment #3 — 9/27/2019): Requested Changes (Note: The County will approve this easement plat
SUB201900091 without any further revision, after corresponding roadplans SUB201800044 are approved and bonded,
provided that the road plans are approved without revisions to any of the easements shown on SUB201900091)
[14-302(A)51 Public Easements. Revise note #6 as follows: "This plat hereby dedicates to public use the temporary
construction easements and the ACSA waterline easements shown hereon. " The note currently references a drainage
easement, but no drainage easements were found on this plan. This note shall reference the correct easement labels if
they are modified.

1. [Recommendation] As currently proposed there are four plats each with multiple pages all depicting various portions
of the necessary easements over multiple properties. This methodology of platting the various required easements
increases the likelihood of error and is difficult to review. In the next submittal, please include a locator map, as an
inset map, to indicate which areas of the development are shown by each sheet. Rev 1. Comment addressed.
[14-302(B)5, 30.7.4(b)] Preserved Slopes. The private utility easement for the sanitary sewer lateral is depicted
through preserved slopes. This use is not permitted in preserved slopes, revise the easement and the improvement to be
outside of the preserved slopes. Please coordinate with ACSA and Jonathan Showalter of Timmons Group.
Rev 1. Pending ACSA review and approval of the modified easement width.
[14-303, 14-302.(A).5, 14-303.(L), 14-3171 Rev. Comm. #3 — (9/27): With the most recent submittal of the

22. [14-302(A)4] Private Easements. Prior to site plan and subdivision plat approval, either provide a new easement over
the existing sewer line on TMP 77-9A which connects to the existing RWSA easement or provide a maintenance
agreement with RWSA and the owners of TMP 77-9A & TMP 77-9 to permit the owners of TMP 77-9 to conduct
maintenance of the existing line and for the connection to be made.

23. 114-302(A)5, 14-3111 Public Easements. The drainage easements being dedicated to public use shall be labeled as
follows: "—feet wide public drainage easement hereby dedicated to the County of Albemarle for public use. " (Please
fill in the appropriate width for the specific easement.)
Rev. Comm. #3 — (9/27): Addressed.
24. [14-302(A)5, 14-3111 Public Easements. Ensure all drainage easements required for the public right-of-way are labeled
as commented on in the previous review comment.

25. [14-302(A)4] Private Easements. The previous plat depicted a new temporary construction easement (685 SF) on TMP
77-9A associated with the drainage easement, depicted on sheet 4; however, this plat no longer provides it. Please
explain why it is no longer needed/required. The temporary construction easement shall be granted to the property
owner who is responsible for constructing the improvements within the easement, the owner of TMP 77-9, Lighthouse
Land, LLC.
Rev. Comm. #3 — (9/27): No objection.
26. [14-302(A)4, 14-302(A)5] Easements. While all proposed easements on sheet 3 appear to match the site plan, it is very
hard to read. Please revise the scale of this sheet so it is easier to read and distinguish the various easements being
platted.

the construction, use, and maintenance of the public road shall be approved on a road plan and built or bonded pursuant
to Section 14-434, 14-435, and 14-435.1 of the Subdivision Ordinance.

15. 114-302(A)41 Private Easements. Revise note #6 to omit the temporary construction easement from being dedicated to
public use. The temporary construction easement shall be granted to the property owner who is responsible for
constructing the improvements within the easement, the owner of TMP 77-9, Lighthouse Land, LLC.

Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is kept up to
date by the County Attorney's office. The Code may found on the County Attorney's website which may be found under
"Departments and Services" at Albemarle.org. In accordance with the provisions of Section 14-229(B) of Chapter 14 of the
Code if the developer fails to submit a revised final plat to address all of the requirements within six (6) months after the
date of this letter the application shall be deemed to have been voluntarily withdrawn by the developer.
