Rev. 1: June 2, 2019
Rev. 1: UPDATE: June 4, 2019
Rev. 2: July 12, 2019
Rev. 3: September 4, 2019
Rev. 4: September 27, 2019
Subject: SDP-2018-0091 (Oakleigh — Minor Site Plan Amendment)
The County of Albemarle Planning Division will recommend approval of the plan referenced
above once the following comments have been satisfactorily addressed (The following comments
are those that have been identified at this time. Additional comments or conditions may be added
or eliminated based on further review.): [Each comment is preceded by the applicable reference,
which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
[ZMA2016-15 Proffer #4] Rev. 2: A draft version of the Covenant and Restriction
document has been provided for review. This document includes a provision for public
pedestrian access (11.11) for all of Oakleigh. Since the C&R provides the required
pedestrian access specified in Proffer 4 the provision for the public pedestrian access must
be approved by the County and the C&R must be recorded prior to this minor site plan
amendment's approval, as required by Zoning and the County Attorney. In addition,
address the following comments from the County Attorney and Zoning within the C&R:
Rev. 3: Comment not yet fully addressed. The C&R must be recorded prior to this
minor site plan amendment's approval. A receipt for recordation and a copy of the
signed and notarized C&R must be provided to the reviewer.
Rev.4: Comment not vet fully addressed. A revised C&R was received on 9/18.
Please address the following:
a) REQUIRED REVISION: On page 17, in 7.1, there are references to "porous
concrete pavers". Because "porous concrete pavers" are only used on
part of the site, sometimes this reference is correct and sometimes it is
not correct. In recent submissions of the site plan the material in Block 5
was changed to "Permeable Pavement" which is a different type of
material and as specified in the detail on sheet 8 it is actually a type of
"asphalt" and not concrete. Earlier in the paragraph the reference to
"porous concrete pavers" is correct, since it is referring to the other
Blocks/Lots of Oakleigh and not Block 5. However, in the last sentence on
the page, when it is referring to Block 5, it needs to be changed to
something like "permeable asphalt".
b) SUGGESTED REVISION: There appears to be a typo at the beginning of
the signature page for "Oakleigh Albemarle, LLC (page 41) when it states
"N Witness Whereof".
c) REQUIRED REVISION: On page 14, in the Description of the Property, Lot
4A, Lot 6 and Lot 6A do not have the Tax Map Parcel listed although then
have their own tax map parcel number and all of the other parcels in the
description have their Tax Map number specified. Add the tax map
parcels for those parcels.
d) The C&R must be recorded prior to this minor site plan amendment's
approval. A receipt for recordation and a copy of the signed and notarized
C&R must be provided to the reviewer.
4. [32.5.2(i) & 32.6.2(a)] Easements. Rev. 2: Address the following:
a. An easement plat has been submitted, reviewed and comments provided 7/5/2019.
The easements must be approved, recorded and proof of recordation provided to
the planning reviewer prior to the approval of the minor amendment.
Rev. 3: Comment not yet fully addressed. The easements must be approved,
recorded and proof of recordation provided to the planning reviewer prior to the
approval of the minor amendment.
Rev.4: Comment not vet fully addressed. Address Rev. 3 comment.
13. See the attached comments from the other reviewers.
Rev. 3: Comment not yet fully addressed. See the remaining comment from engineering.
Rev.4: Comment not vet fully addressed. Engineering comments are still pending
and will be forwarded to you when they are available.

Code is kept up to date by the County Attorney's office. The Code may be found on the County

In accord with the provisions of Section 32.4.3.5 of Chapter 18 of the Code if the developer fails to

this letter the application shall be deemed to have been voluntarily withdrawn by the developer.
