Subject: SUB201900057 Lovell Properties TMP 70-48B - Final Subdivision Plat (Step 2)
The County of Albemarle Planning Division will grant or recommend approval of the Subdivision Plat
referenced above once the following comments have been addressed: [Each comment is preceded by the
applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
[14-312, 4.6.3] Location of existing buildings. As previously discussed please revise the plat to provide
distances to the private street easement from the existing structures. The front and side setbacks from a
private street are 25' on an internal private street. Ensure the existing structures are a minimum of 25'
from private street easement (see example below).

2. 114-302(B)(81 Yards. On the plat provide a note with the required yards/setbacks. Rev 1. Comment
Addressed.
3. [14-303(E)] Private street. Revise the private street easement note to read: "Proposed 30' private street
easement". Rev 1. Comment Addressed.
4. 114-235, 14-303(N)] Private street. Provide the following note: "The streets in this subdivision may not
meet the standards for acceptance into the secondary system of state highways and will not be
maintained by the Virginia Department of Transportation or the County of Albemarle. " Rev 1.
Comment Addressed.
5. [14-302(A)] Right offurther division ofproposed lots. Revise the development rights note as follows:
"Parcel 3 is assigned I development right and may not be further divided. The residue of TMP 70-48B
is retaining I development right and may not be further divided. " Rev 1. Comment Addressed.
6. [14-302(A)15] Identification of all owners and certain interest holders. On the plat include the address
of all the owners of TMP 70-48B. Rev 1. Comment Addressed.
7. [14-302(B)5] Zoning classification. Revise the zoning note to also include Entrance Corridor overlay
district. Rev 1. Comment Addressed.
[14-302(B)7] Include a water supply watershed note as follows: "This site lies within the Albemarle
County South Fork Rivanna Reservoir Water Supply Watershed. " Also include a notation that the site is
not in an agricultural -forestal district. Rev 1. Surveyor corrected the watershed comment and the
agricultural -forestal district comment. Comment Addressed.
9. [14-303(0)&(P)] Signature panels. Revise the County's signature line to read: `Agent for the Board of
Supervisors". Rev 1. Comment Addressed.
10. [14-303(Q)] Water Supply. Provide the following note: "Under current county policy, public water
and/or sewer will not be available to this property. Rev 1. Comment Addressed.
11. [14-302(A), 4.2.11 Building site. Revise the building site note to include TMP 70-48B as follows:
"Parcel 3 and the residue of TMP 70-48B each contain a building site that complies with Section 4.2.1
of the Albemarle County Zoning Ordinance. " Rev 1. Comment Addressed.
12. [14-302(B)(1)] General Information. When the plat is revised, please provide the date of the last
revision on the plat. Rev 1. Comment Addressed.
13. [14-303(S)] Control points. Control points must be submitted. At the option of the subdivider, the
control points may be shown on a copy of the final plat, rather than on the original final plat. Rev 1.
Comment Addressed.
14. [14-309 & 14-3101 Soil evaluations; Health Director Approval of Wells and Septic Systems. Prior to
final subdivision plat approval each lot shall have a primary and reserve drainfield location and
individual well approved by the Health Department. Please provide the soil work for each lot and staff
will forward it onto the Health Department for their review/approval. Rev 1. Comment not addressed.
15. [14-235, 14-317] Instrument evidencing maintenance of improvements. Provide a private street
maintenance agreement for County Attorney review and approval prior to final plat approval. Rev 1.
Comment not addressed.
16. [Comment] This plat is the second step in a two-step process. It shall not be approved and recorded in
the clerk's office until step 1 (SUB2019-56) is approved and recorded in the clerk's office. Rev 1.
Comment still relevant.
Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is
kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which
may be found under "Departments and Services" at Albemarle.org.
In accord with the provisions of Section 14-229(B) of Chapter 14 of the Code if the developer fails to submit a
revised final plat to address all of the requirements within six (6) months after the date of this letter the
application shall be deemed to have been voluntarily withdrawn by the developer.
