If gray -scam, Addressed. Sheet 1 1. Plat date is May or June, 2019. This is a new unrecorded plat. It is initial review of file SUB201900104. Delete all dates displayed with plat title. Provide a single initial plat date. 2. Recently recorded plat signature panels for Oakleigh Albemarle, LLC, do not provide print information for authorized signatory. Signature of owner on recorded plats is unreadable. Print name beneath signature line in signature panel for this owner. 3. Owner signature panels: Identify which parcels /lots are owned by Oakleigh Albemarle, LLC, and which by The Blake at Charlottesville, LLC. 4. Note 12: On graphic portion of plat indicate corners where irons will be set. Abbreviate, and indicate irons to be set at all new property corners upon completion of construction. (Rev. 1) Comment persists, but revised to recommendation. If recommendation is not accepted, comment will be withdrawn. (Rev. 2) Addressed (Sheet 1, Note 12). 5. Note 13 appears twice. Please delete one or the other. 6. Title re£ list includes an unrecorded plat d. 5/30/2003. It is unclear why since legal effect of an unrecorded plat, though informative, is uncertain. Defer to Planning whether to retain reference to an unrecorded plat. (Rev. 1) Comment persists. Engineering defers to Planning. Comment will be withdrawn if Planning does Engineering Review Comments Page 2 of 4 not object. Legal review may likewise comment on this item (ask same /related question). (Rev. 2) Not addressed. Applicant response (13 Sep 2019): `The reference to the "unrecorded plat" noted on Sheet 1 will not be removed. This [note] has been on previously approved and recorded plats. This is one of the basis for creating the subdivision and apparently a normal standard practices among licensed surveyors and furthermore is dictated by DPOR requirements.' While uncertain what is dictated by DPOR, Engineering relies on recorded plats since recordation is a step that establishes lines or boundaries in chain of title, serves public notice, and helps define property rights or limits. Position outlined appears to imply that a graphic designer (licensed, or otherwise) may produce linework, print a document, not record it, yet later include reference on a recorded plat to this "unrecorded" document. This introduces uncertainty. CDD questions what legal effect an "unrecorded" plat has. As follow-up, for now, at a minimum, provide copy of "unrecorded plat" for CDD review. Also, please clarify statement that reference to "unrecorded plat" should remain on plat under review since `dictated by DPOR requirements.' Please reference relevant DPOR requirement/s. (Rev. 3) Withdrawn per Planning Div. guidance. Recommend list plat at deed bk.-pg. 4928-61, which is relevant. Recommend list plat at deed bk.-pg. 5051-627, which is relevant. Include Ownership information (name, TMP #) on graphic plat for Lots 1, 2, 3, 4, 4A, 5, 6, 6A. (Rev. 1) Addressed; listed on sheet 1. Sheet 10. Lot 4A: Show Ex. SWM Easement lines. If SWM Easement exactly coincides with Lot 4A lot lines, provide note to this effect on sheets 2, 3, 4. If SWM easement and 4A lot lines are not identical, provide easement metes and bounds. (Rev. 2) Addressed on plat sheet 4. 11. Provide bk.-pg. ref. for Rio Road. 12. Revise bk.-pg. reference (Lot 4) to read: "All existing easements platted by D.B. 4928 P. 61 within Lot 4 boundaries established by plat recorded at D.B. 5051 P. 627 are hereby vacated. All existing easements in Lot 4A are to remain." (since plat at bk.-pg. 5051-627 creates Lot 4A, and plat under review does not vacate SWM facility (or other) easements on Lot 4A.) Sheet 3 13. Engineering recommends an open space table correlate revised open space areas across lots and plats recorded at bk.-pg. 4928-61, 5051-627 and current plat, but defers to Planning. 14. Identify and label two existing monuments on property boundary. (14-303.L) 15. Provide leader line for segment bearing S64°53'22"E (34.44') along Rio Road to distinguish this boundary segment from easement line segment, L32. (Rev. 1) Withdrawn; no longer applicable. 16. Revise L13 to read L31 (transposition). 17. This plat does not adjust boundaries of Lot 5, or create Lot 6 or 6A, which are shown by plat recorded at bk.-pg. 5051-627. Remove hatching /combined area symbols on Lot 5, 6, 6A, since these changes were recorded with plat at 5051-627 (p. 635, image belwA; Images removed with Rev. 2), yet appear to be proposed with this plat. Sheet 3 does not revise Lots 5, 6, or 6A. 18. Detail A: Provide tie distance for C1 to boundary. 19. Provide and extend 40' private street easement from Lot 6 lot line to approximate point interior to Lot 4 where 1-way travel and 2-lane travel ways diverge. Revise easement areas to correlate revised SWM easements across lots and plats recorded at bk.-pg. 4928- 61, 5051-627 and current plat. At a minimum, include Lots 4, 4A, 6, 6A. Recommend: a. Show revised easements in column format, with headings plat A, plat B, revised easements (ftz). Provide abbreviation index ref: Engineering Review Comments Page 3 of 4 i. Plat `A' is plat recorded at bk.-pg. 4928-61. ii. Plat `13' is plat recorded at bk.-pg. 5051-627. b. Include Lots 1, 2, 3, 5 in revised table. If no change one plat to the next, then listing area in table will clarify, and make explicitly clear. c. Alternative to b., if area of SWM Easement on a lot (Lot 2, for example) is unchanged across all 3 plats, then include plat note to that effect, ref. prior recorded plats, and do not list SWM easement area information unchanged with any plat, and with all three plats. Note: It is confusing, for example, to read total new revised SWM Easement=12,650.36 sq. ft. when plat at bk.-pg. 4928-61 lists total SWM Easement (Lots 1, 2, 3, 4, 5)=114,597.91 sq. ft. d. Also, SWM easement, Lot 5, on plat recorded at bk.-pg. 4928-61=55,700.97 sq. ft., while sheet 4 lists new revised SWM easement Lot 5=1,061.13 sq. ft. 54,639.84 sq. ft. SWM easement on Lot 5 is not vacated with this plat, and was not vacated by prior plat. e. Present in row -column table format; include all three plats in table. 22. Provide legend re£ to dot -dot pattern (ACSA easement). (Rev. 1) Withdrawn. 23. Label line segment, L48. 24. Label arc between C61 and C62, and include data in curve table. (Rev. 1) May persist. As follow-up: Please confirm that only Arc C62 and no other arc or segment lies between Arc C61 and Arc C63. (Rev. 2) Addressed. Applicant response: `There is no additional arc or segment between C61 and C62.' 25. Provide inset details (1" =20') for areas centered on C54 and C64. 26. Label L92. 27. At east end L92, include `(tie)' after 12.60' distance. 28. Provide ties to two permanent monuments on exterior boundary. Provide northing /casting for these monuments. At text label reading `ties to Existing SWM Easement' include a bk.-pg. ref. to recorded Ex. easement. 32. Sheet 5: Provide SWM Easement curve table data for arcs C50 - C67 (f). 41190 33. Note: Deed of Vacation and Dedication of Easement must be reviewed and approved by legal /CAO, before county Authorized Agent approves the easement plat, meaning, plat cannot be approved until deed of dedication (including SWM facility /Access easements; deed submitted with latest plat submittal), passes CAO review. (Rev. 3) Partially addressed. As follow-up: a) sheet 6 current plat SWM Easement value (11, 884.34) does not match sheet 4 text label Q 1,584.32), and b) neither value appears consistent with Deed, p. 4 text, which reads: "...the parties herby vacate all portions of the stormwater management easement lying over Lot 4 (as such Lot is shown on the Revised Subdivision Plat) as such easement is shown and identified on Sheet 6 of the Existing Easement Plat as "NEW SWM EASEMENT, 23,438.36 SQ FT".
