The County of Albemarle Planning Division will grant or recommend approval of the plat referenced
above once the following comments have been addressed: [Each comment is preceded by the applicable
reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-302(A)3] Indicate on the plat where the state maintenance of Lackey Lane (State Route
838) ends, such as with the location of an "End of State Maintenance" sign. It is unclear where
the state route ends and the private right-of-way/easement begins. It appears that it may be at
the railroad crossing.
2. [14-302(A)9] Identify where the building sites of at least 30,000 square feet are on revised
parcels 109-9C and 109-1OC. These parcels have many areas of critical slopes on them, and it
is unclear where the building sites stated in Note F of the plat are located.
3. [14-302(A)10] Review the development rights notes (Notes C — E) indicating how many
development rights each parcel has available and whether any are being transferred with this
boundary line adjustment. Reviewing past plats, it appears that the development right for
existing TMP 109-1OC came from the area that is now identified as "Parcel R," which is more
or less the boundaries of the original 1980 parcel. However, that area and its development right
are now being transferred to TMP 109-1OB, leaving revised TMP 109-1OC without any
development rights (the "kernel rule"). It appears that all of revised TMP 109-1OC has been
subdivided off from the original TMP 109-9C over the course of several different plats.
However, Note C indicates that revised TMP 109-9C continues to have all five (5) of its
original development rights. Please clarify this transfer of development rights.
4. [14-309; 14-310; 14-4161 Any resulting lot from a boundary line adjustment that is less than
five (5) acres in size must receive Health Department approval prior to a plat being granted
County approval. However, soils work was provided only for revised TMP 109-1OC. Revised
TMP 109-1OB will also be less than five acres in size and also requires Health Department
approval. Provide soils work or previous Health Department approval for revised TMP 109-
1 OB.

Easement
Dear Mr. Reitelbach:
The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced Boundary Line Adjustment Plat & New 20' Access
Easement, as submitted by Roger W. Ray and Associates, Inc., dated August 08, 2019 and find it
to be generally acceptable.
A VDOT Land Use Permit will be required prior to any work within the right of way. The
owner/developer must contact the Charlottesville Residency land Use Section at (434) 422-9399
for information pertaining to this process.
