Subject: SUB201900142 Wyant Lane BLA and Consolidation Plat
The County of Albemarle Planning Division will grant or recommend approval of the Boundary Line
Adjustment Plat referenced above once the following comments have been addressed: [Each comment is
preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise
specified.]
1. [14-302(A)10] Right of Further Division of Proposed Lots. Note #17 is incorrect. There is 1
development right associated with TMP 72-36C1 (32.355 ac), which remains with the 3 acre
portion of the original 5 acres. TMP 72-36C5 (5.489 ac) contains 1 development right that needs
to be allocated with either Parcel "A" or Parcel "B". Additionally, TMP 72-36C (10.042 ac) only
contains 1 development right. Revise.
I offer the followiniz revised note #17. if you choose to allocate the development right from TMP
72-36C5 with Parcel A (2.744 AC), which is being added to TMP 72-36C1: "Tax Map/Parcel
72-36C1 is assigned 2 development rights and may be further divided. Tax Map/Parcel 72-36C is
retaining I development right and may not be further divided. No development rights are
transferred with Parcel B. "
I offer the followine revised note #17. if you choose to allocate the development rieht from TMP
72-36C5 with Parcel B (2.745 AC), which is being added to IMP 72-36C: "Tax Map/Parcel 72-
360 is retaining I development right and may be further divided. Tax Map/Parcel 72-36C is
assigned 2 development rights and may be further divided. No development rights are transferred
with Parcel A. "
2. [14-302(A)4] Private Easements. For each private easement label the name of the owner of
record.
Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is
kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which
may be found under "Departments and Services" at Albemarle.org. In accord with the provisions of Section 14-
229(B) of Chapter 14 of the Code if the developer fails to submit a revised final plat to address all of the
requirements within six (6) months after the date of this letter the application shall be deemed to have been
voluntarily withdrawn by the developer. Please contact Christopher Perez in the Planning Division by using
