Subject: SUB201900143 Wyant - Family Subdivision
The County of Albemarle Division of Current Development will grant or recommend approval of the Family
Subdivision plat referenced above once the following comments have been addressed: [Each comment is preceded
by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-211(C), 14-400, 14-303(E), 14-412, 14-4031 Frontage. Lot 1 is not provided frontage. It appears Lot 1 is
attempting to gain its frontage from the proposed 30' access easement; however, in order for this easement to
provide the required frontage the easement must be for a Private Street. Thus the proposed 30' access easement
shall be relabeled to `New 30' Wide Private Street Easement". Also, the easement holder(s) shall be identified
on the plat.
2. [14-303(N), 14-412(A)(4)] Statement pertaining to private streets. Provide the following notes on the plat: "The
streets in this subdivision may not meet the standards for acceptance into the secondary system of state
highways and will not be maintained by the Virginia Department of Transportation or the County of
Albemarle. " and "The existing and/or proposed right-of-way is of adequate width and horizontal and vertical
alignment to accommodate a travelway passable by ordinary passenger vehicles in all but temporary extreme
weather conditions, together with area adequate for maintenance of the travelway, as required by section 14-
412 of the Albemarle County Code. "
3. [14-212] Affidavit. Provide a completed, signed, and notarized affidavit verifying family relationship of grantor
to grantee (see attached).
4. [14-212(B)] Conditions of approval. The subdivider shall place a restrictive covenant on the lots created by the
family subdivision. A template for this covenant is attached. Please utilize the template and submit the
completed affidavit to Planning staff to forward to the County Attorney. County Attorney approval is required
prior to final subdivision plat approval.
5. [14-302(A)(9)] Building sites on proposed lots. Revise the following note on the plat: "Lot I and the residue of
Tax Map 26 Parcel 32 each contain a building site that complies with section 4.2.1 of the Albemarle County
Zoning Ordinance. "
6. [14-302(A)3] Existing or platted streets. Provide the name of State Route 672. It is Via Lane.
7. [14-302(A)(10)] Right of further division of proposed lots. Revise the development rights note as follows: "Lot
I is assigned I development right and may not be further divided. The residue of Tax Map Parcel 02600-00-00-
03200 is retaining 2 development rights and when further divided it shall not consist of more than 13.57 acres. "
8. [14-316, 14-212(C)] Approval of entrance onto public streets. The entrance of the principal means of access for
each lot onto any public street shall comply with Virginia Department of Transportation standards and be
approved by the Virginia Department of Transportation. Prior to final subdivision plat approval submit
documentation from VDOT that the proposed entrance along State Route 672 complies with their standards.
The plat has been sent to VDOT, once their review comments are received I will forward them to you.
9. [14-302(B)8, 18-10.41 Setbacks. The setbacks listed and depicted on sheet 2 are incorrect and shall be revised.
Rural Area (RA) setbacks are as follows:
Front (existing public roads) — 75'
Front (internal private roads) — 25'
Side — 25'
Rear — 35'
10. [14-302(B)7] Reservoir watershed. Revise the watershed note as follows: "This property lies in the Doyles
River Water supply Watershed".
11. [14-302(B)1] General Information. When the plat is revised provide the date of the last revision on the plat.
12. [14-309 & 14-3101 Soil evaluations; Health Director Approval of Wells and Septic Systems. Prior to final
subdivision plat approval each lot shall have a primary and reserve drainfield location and individual well
approved by the Health Department. Please provide the soil work for each lot and staff will forward it onto the
Health Departmentfor their review/approval.
13. [14-303(S)] Control points. Provide at least 4 control points, evenly distributed across the property and located
at survey property corners. At the option of the subdivider the control points may be shown on a copy of the
final subdivision plat rather than the original signed/notarized version for recordation.
14. [14-302(B)10] Stream Buffers. Depict and label the stream buffer on TMP 26-32C and TMP 26-32. Provide the
following note: "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle
County Water Protection Ordinance. "
15. [14-302(B)1] General Information. When the plat is revised provide the date of the last revision on the plat.
16. [Recommendation] Instrument evidencing maintenance of certain improvements. It is recommended a private
street maintenance agreement be provided for the proposed private street. A template can be found for this
document at:

Please utilize the template and submit the completed agreement.
Staff has provided references to the County Code. The Code is kept up-to-date by the County Attorney's office and
may be found at www.albemarle.or /cg ountycode. In accord with the provisions of Section 14-229(B) of Chapter 14,
if the subdivider fails to submit a revised plat to address all of the requirements within six (6) months after the date
of this letter, then the application shall be deemed voluntarily withdrawn. Please contact Christopher Perez at the
