May 13, 2016 Mr. Chris Perez Senior Planner Albemarle County Department of Community Development Regarding: SDP 2016-0007 Inglewood Terrace Request for Private Street Authorization Request for Waiver of Street Standards Dear Mr. Perez, The Albemarle County Subdivision Ordinance allows the commission and/or agent to waive certain road/street requirements that will permit creative design alternatives that would "...accomplish county goals, policies, good planning practice and good engineering practice." We therefore request the following: 1) In accordance with Section 14-225.1, the Applicant requests a waiver, for Inglewood Terrace Road as shown on the Inglewood Terrace Site Plan, of Section 14-410(H) 'Curb,curb and gutter,sidewalks and planting strips. In the development areas,streets shall be constructed with curb or curb and gutter,sidewalks and planting strips. Sidewalks and planting strips shall design and constructed in compliance with section 14-422." The Applicant would like to waive the requirement for a sidewalk on the east side of Inglewood Terrace Road as shown on the Application Plan. A continuous sidewalk and landscape strip shall be provided on the west side of the road. Providing a sidewalk on the east side of the road has no added benefit to the public since there are no houses on the east side. Furthermore, the applicant believes that providing extra screening in place of a sidewalk will be in greater benefit to the new development and the surrounding neighborhood. 2) In accordance with Section 14-225.1, the Applicant requests a waiver, for Inglewood Terrace Road as delineated on the Inglewood Terrace Site Plan, of Section 14-422(A)" "Requirement. Sidewalks and planting strips for street trees and other vegetation shall be established on both sides of each new street within a subdivision creating lots for single family detached and single family attached dwellings in the development areas."
